6. What is copyright?
Essentially copyright is a from of protection for intellectual property provided by the laws of the United States for creators of original works including literary, dramatic, musical, artistic and certain other intellectual works.
Copyright lasts 70 years after the death of the owner (author). After that the work goes into “public domain” and may no longer need a license.
To give you an example, in the last couple of months we lost some musical greats, Prince and David Bowie. Though they are no longer alive, their family or estate will still receive royalties from the public performance of their musical works for 70 years from the day of their death.
Types of Music Copyrights?
Mechanical – the rerecording of a musical work. With regards to copyrights of musical recordings, there are at least two distinct copyrights. There is (1) the copyright of the composition, embodied in the sheet music (the “musical work”), which may include separate copyrights for lyrics or composition; and (2) the copyright in the sound recording, embodied as a “phonorecord” (Please note that the law considers ANY tangible medium capable of storing a recording to be a phonorecord. This includes MP3 players, CDs, 8-tracks, vinyl records, cassette tapes, or any future technology.) It is not unusual for one party to own the copyright in the underlying musical work while another, independent, party owns the copyright to the phonorecord.
Synchronization - "sync" for short, is a music license granted by the holder of the copyright of a particular song, allowing the licensee to synchronize ("sync") music with some kind of visual media output (film, television shows, advertisements, video games, accompanying website music, movie)
Master Use - A "master use license" is an agreement by which the Copyright Owner of a Sound Recording (usually, the record company) grants Permission to someone else to use the Sound Recording in a visual work.
Public performance – Deemed public which is defined as a song being played in a situation that is deemed outside the normal circle of family and friends, thus public not private. Public Performance is the right that BMI provides the necessary permission for.

7. So we are all familiar image that comes up on your TV when you decide to watch a DVD at home. The “all rights reserved” notice lets you know that the copyright owner has granted permission for “private” use but playing them before a public audience (such as in a business) is prohibited. The same restrictions applies to the purchase of CD’s, digital downloads from iTunes, etc. When you purchase these songs you have permission to use them in your home or car, but not in a place of business.
Need to define what is private (wedding receptions, anniversary parties, etc.) Also explain charitable events.

So who are the companies in the United States that songwriters affiliate with to collect licensing fees when their musical works are performed in public?
ASCAP – 102 YEARS – Exclusive, certain amount of hits before you could join. Songwriters had to pay to join. ASCAP’s board is comprised of songwriter and publishers.
SESAC-Over 85 years. Exclusive, for profit. Songwriters and publishers are asked to join.
BMI- Over 75 years, open door, BMI was started by a group of radio broadcasters as SESAC and ASCAP’s fees were increasing 500% over 5 years. Free for songwriters to join.
GMR-Started in New Player. Small selective group and it’s run by investors.
