2. Overview:
Intellectual property law is concerned with the legal regulation of mental products. It affects such diverse subjects as the visual and performing arts, new plant varieties, electronic databases, advertising, insulin producing bacteria, and video games.
Since intellectual property is such a dynamic, rapidly changing area of law, many of the cases and statutes discussed are of quite recent vintage

3. What is “intellectual property” ?
The concept "intellectual property" is seldom defined in national laws of the different states. There is no special necessity as this concept is defined at the international level, namely in article 2 of the Convention which is established the World organization of intellectual property(1967) (the Stockholm convention). It specifies rights which includes of the intellectual property :
literary, art and scientific products;
executive activity of actors, a sound recording, radio and telecasts;
inventions in all areas of human activity;
discoveries;
industrial samples;
trademarks, company names and commercial designations;
all other rights following from results of intellectual activity in industrial, scientific, literary and art spheres.
To protect your idea you ought to create your own trademark. The owner of a registered trademark may commence legal proceedings for trademark infringement to prevent unauthorized use of that trademark.

6. How to secure the right to intellectual property ?
The rights to inventions, utility models, industrial designs, trademarks require state certification of the patent or certificate.
To get that proper protection is necessary to make an application for its receipt, it forms are provided in the following laws:
Order of the MES of Ukraine № 22 "On approval of preparation and submission of applications for invention and utility model applications;
Order of the MES of Ukraine № 110 "On approval of drafting and filing of applications for industrial sample;
Order of the State Patent of Ukraine № 116 "On approval by Rules for drafting and submitting application for a Certificate of Ukraine to sign for goods and services

7. In the protection of Intellectual Property
Experts believe that the creation of an efficient system of the protection of intellectual property is hampered above all by an imperfect national legal system. Another obstacle is the prevailing negligence for the protection of intellectual property in society, the absence of adequate information on
protectionist activities in the sphere of intellectual property. However, even the experts tend to underestimate the social-economic mechanisms of the protection of intellectual property.
