2 Quarterly Update: 1 May to 31 July 2016
Terms of Negotiations and Urgent Hearings On 2 May 2016 the Waitangi Tribunal granted urgent hearings into the Crowns recognition of the Ngatiwai Trust Boards Deed of Mandate When the Tribunal granted hearings the Board paused the recruttment prcess for the remaining two negotiators having already appointed its negotiator. Discussion on all the supporting structues will continue in the meantime and be reviewed following the outcome of the Ngatiwai Mandate Inquiry. The Board resolved to remove Te Kapotai and their respective Wai claims from the Deed of Manate on 27 May 2016 and subsequently amended the DoM. The Board signalled it was open to mediation with claimants but only one claimant group expressed an interest. Therefore the Tribunal did not see any point in pausing the hearings process for mediation to occur. Urgent hearings are to take place at Toll Stadium on 4, 5 and 6 October 2016

Overlapping Claims The Board has concluded its engagement with Ngati Paoa concerning redress offered to them by the Crown in relation to Te Haupa (Saddle Is) scenic reserve. The reserve is to be vensted in Ngati Paoa and vested back to the Crown. A letter of support was provided to Ngati Paoa on 31 May 2016. The Board has engaged with Ngati Rehua Ngatiwai ki Aotea Trust and the Office of Treaty Settlements in relation to their claimant definition, area of interest and redress offer. Discussions are ongoing with a Deed of Settlement expected to be signed by the end of the year. The Board continued to inquire into the circumstances surrounding the Crowns offer of recress to Ngati Maru, Ngati Tamatera and Patukirikiri of the Marutuahu confederation for redress on Aotea.
