Copyright Infringement - Using works that are protected by copyright law without permission from the copyright owner Penalties – Civil and criminal penalties; be ordered to pay for damages or “statutory” damages; imprisonment

3 What does the term “fair use” mean
What does the term “fair use” mean? Who is included in the fair use clause? Fair Use – Any copying of copyrighted material done for a short amount of time and transformative purpose, like comment upon, criticize, or parody of copyrighted work Who is included? – Educators, students, critics

4 What are the conditions for deciding fair use?
There are Four Factors that judges uses Purpose and character of your use Nature of the copyrighted work Amount of the portion taken Effect of the use upon the potential market

5 When using multimedia in the classroom, what needs to be considered when determining copyright has been adhered to? There is proper credit and citations to the owner Opening screen says their presentation has been prepared under fair use exemption Must display the copyright notice and copyright ownership information

6 What are the conditions for using someone else’s words?
Up to 10% of a copyrighted work or 1000 words For poems: Entire poem if less than 250 words No more than 5 poems of different poets Only 3 poems per poet

7 What are the conditions for using another’s musical score?
Up to 10% of a copyrighted musical composition, but no more than 30 seconds Any altercations cannot change the basic melody or the fundamental character of the work

8 What are the conditions for using film in the classroom?
The teacher must be present in the classroom, engaged in face-to-face teaching activities Both teachers and students have rights to perform or display any works Ex. – Playing movies and music for students at any length; Students perform/act out scenes and read poems

9 What if you want to tape something off the TV to use in the classroom?
You can record television programs transmitted by network television and cable station up to 45 days and is only used for instructional purposes. After 45 days, the recording must be erased or destroyed.

10 How can you get permission to use items in your classroom?
A teacher can let the school get permission to access it so then the other teachers can have access to it Contact the publisher so they can give you permission and to access it

11 When items are posted to a website, what should the creator be careful to consider?
The creator should be aware that everything posted is not copyrighted by someone else They may have to ask for permission before posting on their website
