2 Work Requirements The American Health Care Act (AHCA, H.R. 1629) and the Better Care Reconciliation Act (BCRA, H.R. 1628) would both have provided a state option to implement work requirements States would not have had to request Section 1115 waiver authority Eight state are seeking to add work requirements to Medicaid as a condition of eligibility. To-date, only Indiana and Pennsylvania have been permitted to refer Medicaid applicants to voluntary work support programs.

5 Proponents’ Perspective
Work requirements in Medicaid: Addresses social determinants of health, Would incentivize work among low-income populations, Help transition Medicaid enrollees off the program (ideally to employer-sponsored insurance), and Decrease reliance on public programs. Proponents also point to gains in employment among affected populations following the imposition of work requirements as part of welfare reform in 1996 (HHS 2017, U.S. Committee on the Budget 2017)

6 Opponents’ Perspective
Also citing the TANF experience, opponents believe work requirements in Medicaid would do little to increase employment among this population due to the majority of adults in Medicaid are currently working or meeting other proposed exemptions (such as having a disability) Contend requirements would impose a considerable administrative burden on states and lead to coverage losses (Rosenbaum et al. 2017, Katch 2016)

7 Features of Work Requirement Proposals
The definitions of work activities being proposed are similar to the standards used in TANF. Exemptions to the work requirement Individuals determined to be physically or mentally unable or with exemptions from other programs, students and caretakers Activities that satisfy the work requirement Employment, job training, volunteering Participation hours generally set at 20 per week or 80 per month Penalties for not satisfying the work requirement Disenrollment Disenrollment with a lock-out period Time limit on enrollment 7
