Spill Response and ASTs
SB 373 established new aboveground storage tank (AST) regulations for tanks greater than 1,320 gallons (regardless of contents). Tanks are now registered and inspected by DEP Tanks now require approved spill prevention and response plans (SPRP). Tanks now require annual certification by a registered professional engineer SPCC Plan. The SPCC plan covers all tanks containing petroleum-based products only, regardless of container size. Spill response and prevention plans are also part of the SPCC plan. Groundwater Protection Plan (GPP). A GPP is approved for every mine site that has a separate spill response plan. GPP covers all tanks and potential groundwater contaminants, regardless of the tank size. Most of the fundamental requirements of the spill response plan is the same in all three plans (SPRP, SPCC, and GPP).

Oil / fuel storage & management
Used / New Oil Storage Secondary Containment is required A fully stocked spill kit must be available nearby New oil is stored in covered bins and used oil is stored used oil tanks at designated locations. Housekeeping is important. Keep all oil stains in the soil cleaned from around the tanks and bins, and in equipment maintenance areas. SPCC, GPP, and SPRP plans currently require regular inspections of each oil storage bin or tank. Fuel Storage All tanks must be labeled with the correct label Tanks need to be inspected regularly for leaks, bad hoses/connections, water accumulation in secondary containment, improper labeling, etc. The Buffalo Energy – SPCC plan requires inspections at least monthly by designated personnel for each oil, fuel, and used oil tank. No smoking – No cigarette butts around tanks/bins Used / New Oil Storage Ensure all Oil is stored in a secondary contained area and labeled correctly. A fully stocked spill kit must always be available. Housekeeping is very important. Please ensure there is no trash in or around the containment areas for both Oil and Fuel storage. Open flames are not allowed, and thus no cigarette butts. Fuel Storage All tanks must be correctly labeled and stored in a secondary containment structure. All fuel storage areas must contain a fully stocked spill kit. Tanks are to be inspected regularly for leaks, bad hoses/connections, water accumulation in secondary containment areas and improper labeling. Again, housekeeping is very important.

Spill Response Procedures
Spills should be prevented. But if you do have a spill, first make sure you and others are safe. Contain the spill using spill kits, oil absorbent, earthen dykes, or other means possible. Stop the leak at its source if possible.

Spill Response Procedures
Contact your manager and the environmental department as soon as possible, once the spill has been contained, stopped, and it is safe to do so. The spill must be cleaned, and any material (soil, absorbent material, pads, booms, etc.) must be stored in closed containers within a secondary containment system, and picked up for proper disposal. A spill report should be completed and submitted to the environmental department as soon as practicable.

Spill Response Plans New Spill Prevention and Response Plans will be provided to the mine sites upon approval from WVDEP. The SPCC & Groundwater Protection Plans (GPP) for regulated tanks is kept on file at the Engineering office.

MSDS If you need an MSDS for any substance, call the 3E – SDS Hotline, as shown in the photo. These bulletins should be available at all mine sites on bulletin boards, etc.
