2 Objectives Explain how different groups have different levels of power (including humanitarian workers) Explain how this can lead to abuse State actions which are not permitted by the CI Policy on PSEA Describe the correct procedure for reporting cases of SEA

3 Ground Rules for this session
Maintain confidentiality Listen and respect others Give everyone a chance to speak Be open and non-judgmental Note that we will (and they should) maintain confidentiality of survivors of SEA, and not prejudice investigations. However, if they raise specific, real incidents that are examples of SEA then we will be duty bound to report them. 3

4 CARE’s messages Sexual exploitation and abuse are unacceptable
Any staff member person who has committed an offence will be dismissed. It is your responsibility to report cases of sexual exploitation and abuse. Reporting protects survivors and stops abuse 2. Emphasise that this applies to ANY staff member – senior, junior, international or national. 3. Say we will talk more about reporting, but this should be to your line manager, or to HR or to a whistleblower line.

5 Your Responsibility It is your duty and responsibility to:
Report behaviour that you feel is not in line with the main rules on SEA Actively promote and maintain an environment in which all staff feel that they can report abuses. You agree to this when you sign the Code of Conduct on joining CARE 6

6 Definitions Gender Based Violence Sexual Harassment Sexual Abuse
Note: CARE’s definition of GBV: a harmful act or threat based on a person’s sex or gender identity. It includes physical, sexual and psychological abuse, coercion, denial of liberty and economic deprivation whether occurring in public or private spheres. GBV is rooted in unjust and unequal power relations and structures and rigid social and cultural norms. (from CARE’s GBV strategy) Sexual Exploitation

7 “sexual exploitation”
Definitions “sexual exploitation” means any actual or attempted abuse of a position of vulnerability, differential power, or trust, for sexual purposes, including but not limited to, profiting monetarily, socially or politically from the sexual exploitation of another.

8 “sexual abuse” Definitions
means the actual or threatened physical intrusion of a sexual nature, whether by force or under unequal or coercive conditions.

9 Reporting Mechanisms CARE has its own internal reporting system
CARE will work together and with local communities to establish external reporting mechanisms, so that communities know where and how to report

10 Reporting in CARE Staff should report by whichever means they prefer. This could be: To a supervisor or senior manager To Human Resources department To the whistleblower line/website ( – CARE USA and Canada; / – CARE Australia; – CARE International Secretariat) Involve as few people as possible (increases confidentiality).

11 Cross-Agency Reporting
Managers, focal points or other staff may receive allegations regarding someone from another agency: The principle is confidentiality The aim is for the allegation to reach the appropriate section of the relevant organization as quickly as possible Staff may be asked to make a written statement detailing the allegation

12 Reporting to Local Authorities
Where the alleged act constitutes a crime, the CARE focal point (or any other interviewer) should explore with the complainant (alleged victim) whether they would like assistance with reporting to authorities The decision to report to authorities is solely that of the complainant CARE will normally provide support to the complainant in their case

13 Wrap-up Anyone found engaging in this kind of behavior will have their contract terminated immediately, following an investigation. If they have contravened national law, they will likely be reported to the police (or other legal body), depending on the wishes of the survivor. Everyone must report incidents where the policy is not being followed. Use the correct reporting policy in your office, or use the website/ if you prefer.
