Impaired Driving Elimination Act (IDEA)
HB 3146 passed the 2016 OK Legislative session signed by the Governor Requires DPS Commissioner to create: Impaired Driver Arrest Database Standardized Impaired Driver Arrest Form Requires law enforcement to enter impaired driving arrest data into the database and use standardized arrest form. Requires all impaired driving cases be presented to district attorney unless the municipality is a court of record. Encourage those with questions further than this slide provides to contact their agencies legal advisor or conduct their own research.

The Oklahoma Department of Public Safety Impaired Driver Arrest Database is constructed to collect information regarding: The person arrested. The vehicle involved. The location using GPS capturing for heat mapping. The evidence items. The crimes alleged to have occurred. The facts following the NHTSA/IACP DWI Detection and Standardized Field Sobriety Testing curriculum which includes: Vehicle in Motion Stage Personal Contact Stage Pre-Arrest Screening Stage The post arrest activity. The concept is the arresting officer enters information into a database and then calls the forms they desire to produce which Currently are: Impaired Driver Arrest Report 8 ½ X 11 format Impaired Driver Arrest Report 8 ½ X 14 format Probable Cause Affidavit for Warrantless Custodial Arrest 8 ½ X 11 format Every Oklahoma CLEET certified officer in the past several years were instructed using this curriculum. If officers need an SFST update/refresher please advise Futures and will pass this information to the Oklahoma Board of Tests who has taken a leadership role in providing impaired driving enforcement training.

OK DPS IDD MAIN PAGE The IDC on the left is a hyperlink that takes you to that case. Each person view may differ whether they are officer or supervisor. The search bar today is only looking at the last name of an arrested driver. This will be enhanced on the next build.

OK DPS IDD GENERAL INFORMATION PAGE
Agency Case Number is the case number assigned by the arresting agency. Arrest Type is Alcohol arrests, Drug Impaired Driving Arrests or Combined Influence arrests. Alcohol is when the impairment is ONLY alcohol regardless if this is DUI, APC or DWI Drug is when no alcohol is suspected by drugs are the only thing causing impairment. Combined if when evidence suggests the person was affected by both drug and alcohol. OTHER is for OHP only. When OHP Troopers select other this would be used when the person arrested was NOT arrested for an impaired driving offense. This will change the header on the report so it doesn’t reflect that it is the state impaired driving case report.

OK DPS IDD SUBJECT PAGE For the DOB the user is encouraged to use the calendar features. Demonstrate clicking on the year and moving the calendar backward to the year of birth. The years are in 24 year blocks presented on the page. Then go to the month of birth Then select the day.

The first click on the map provides the lat/long for the location where the violation occurred. The second click provides the lat/long for the point of last drink (if known) Users must provide the location of the arrest and the County of occurrence. The PC Affidavit obtains data from the County field to populate the form. In the Place of Last Drink section provide as much information as you can about the location the person consumed their last drink if known. The arrest location blocks should be completed and not left blank because this populates the information on Page 1 The County box in arrest location should be completed as this will populate several blocks on the PC Affidavit Place of Last Drink provide as much credible intelligence as possible so heat mapping can be conducted for enforcement and prevention counter-measures. If a person can find the POLD easily on the map and click on that location ask them to please do that but not to spend a lot of time if the location of POLD is a long distance from the arrest location.

Explain what is evidence in the impaired driving case. Drugs Documentary evidence such as: Officers Affidavits showing breath test results, refusals and blood forms showing who participated. Video from patrol cars, body cameras and jail videos.

VEHICLE IN MOTION STAGE We want a well written narrative in this section. Narratives should be in proper case and should tell a story. Narratives should start with On Day of the Week, Date and Time and how the officer became involved in this arrest/investigation. Encourage officers to be very descriptive and articulate when describing the violation. TIME BOX it is extremely important the user enters the time as 00:00 AM or PM There must be a space between the last minute and typing AM or PM The AM and PM must be capitalized. This is one of the few validation rules and is to create a standard so data analysis can be worked on a 24 hour clock. Preference is no military time. Very few people reading your report will have served in the military. Note in each box there is a yellow upward/right facing icon that indicates the entry passed the validation rule. If this is not seen the person is not entering the time in the proper format. The use of the wizard narrative is not mandatory except for OHP troopers by direction of the Commissioner and Chief. If another agency desires to bypass this wizard function they can type their own narrative by moving to POST ARREST and selecting the last box OTHER.

PRE-ARREST SCREENING STAGE The paragraph is aligned with the current procedures to properly administer the Horizontal Gaze Nystagmus. If an officer doesn’t perform HGN using the above procedures (example) the person way laying on their back or they deviated in any manner, they would document that in the Non-Standard Sobriety Tests. The question is asked can a prepared narrative be done and will defense attorney’s attack this? The DRE program has used canned reports for over 17 years now with no issues. There is only ONE (1) way to perform the DRE 12 step process. Much the same if you are performing the SFST’s in a standardized format there is only ONE (1) way to do those as well. If the person does not complete the entire test then select NO and explain in the Additional Narrative section what caused the test to be halted.

There will be times when the officer CANNOT click on the map system because they are not familiar with the location where POLD occurred. We do ask that officers put some detail if known in this section so the POLD Analyst can work the data so enforcement and prevention groups can take a data driven focus on locations that overserve or lake areas that need special attention. If a residence regularly hosts parties for minors they may be in violation of the social host law.
