2 Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act Campus Security Authority Training What is the Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act? Referred to as the Clery Act, it is named after Jeanne Clery who was raped and murdered in her dorm room at Lehigh University in Her killer was another student. Her parents believed she would have been more cautious if she had known about other violent crimes which had previously occurred at Lehigh. Congress agreed: the Clery Act, first enacted in 1990 and amended in 1998 and 2013, requires higher education institutions to report crime statistics to current and prospective students and employees. The purpose of the Clery Act is to ensure that students and others are informed about campus crimes so they can make educated decisions.

3 Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act Campus Security Authority Training The Clery Act requires that all institutions of higher education who receive Title IV funding gather crime information based upon the crime’s location, type of crime reported, year in which the crime is reported, and to whom the crime is reported, and provide this data to their campus community. Clery divides the reportable geographic locations into three categories (1) on campus, (2) on public property within or immediately adjacent to the campus, and (3) in or on noncampus buildings or property that the institutions own or control. University of Nevada, Reno Clery Act Geography Includes: Main Campus (which includes): Cooperative Extension locations, Fraternity or Sorority houses recognized by the University, Student housing facilities, Any building or property owned or controlled by the university, is frequented by students, relates to the college’s educational purposes and/or supports institutional purposes (such as food or other retail vendor) Nevada Center for Applied Research (Redfield Campus) Truckee Meadows Community College Clery Act Geography Includes: TMCC Main Campus (Dandini) William N. 8 Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act Campus Security Authority Training There are two types of individuals who, although they have significant responsibility for student and campus activities, are NOT campus security authorities under the Clery Act and are therefore exempt from this reporting requirement. A person who is associated with a religious order or denomination, is recognized by that religious order or denomination as someone who provides confidential counseling, and is functioning within the scope of that recognition as a pastoral counselor; A person whose official responsibilities include providing mental health counseling to members of the institution’s community and who is functioning within the scope of his or her license or certification. This definition also applies to professional counselors who are not college employees, but are under contract to provide counseling.

9 Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act Campus Security Authority Training A CSA must report: Any and all incidents, which may be criminal in nature that are brought to their attention. A CSA report must include: The type of crime reported to them; The location of the crime (if known); The date and time at which the crime occurred (if known); The date and time at which the crime was reported to the CSA.

11 Jeanne Clery Campus Security Policy & Crime Statistics Disclosure Act Campus Security Authority Training Always Remember…. Be upfront with the individual that as a CSA you must report information regarding crimes for statistical purposes. Let the person know about options for reporting to police: Tell the person that he/she can report anonymously to University Police. A person who talks to you may not want to talk to the police – and does not have to – but tell the person you must forward the information. If an individual is adamant about complete confidentiality, direct them to speak with a professional or pastoral counselor. Just Get the Facts University Police Services will determine if a crime has occurred. Your job is to get the information the person wants to tell you. You are NOT a detective. You do NOT have to prove what happened or who was at fault. You are NOT supposed to find the perpetrator.
