2 Protecting Other Rights
2nd Amendment: protects the rights of Americans to own guns, govt. can pass restrictions, very controversial? 3rd Amendment: in peacetime soldiers may not move into private homes without consent, in war Congress must grant permission, why is this in the Constitution? 7th Amendment: in a civil suit you may request a jury if the amount in question is over $20

9th Amendment: Establishes that citizens have other rights beyond those listed in the Constitution, right to privacy? Abortion? 10th Amendment: Any power the Constitution does not specifically give to the national govt. are “reserved” to the states or people, federalism Prevents Congress and the President from becoming too strong

4 Rights of the Accused 4th amendment: if law enforcement wishes to search your home or take your property they must present evidence to and convince a judge to issue a warrant; judge has to believe search could turn up evidence, purpose? 5th amendment: a person can not be tried without being formally charged -can not be tried for the same crime twice, double jeopardy -can not be forced to testify against themselves -will get due process of law Eminent domain: govt. may take your property for public use if they pay a fair price; private for private?

5 Rights of the Accused 6th amendment: citizens must be told what they are being charged with -may have a jury trial -trial must by speedy and public -accused must be permitted to hear and question all witnesses -accused has a right to an attorney and to call defense witnesses 8th amendment: forbids “excessive” bail, and “cruel and unusual punishment”, death penalty?
