Support for the REFIT actions for the ELD
Task 1: Development of the prototype for an ELD data gathering tool 4 and 5 October 2017 www. Milieu.be
2
Outline Process for the development of a prototype for the EU tool
Objective Establishment of the Conceptual Framework and ELD assessment framework as the basis for an EU tool Desk research – implementing situation on data gathering Consultation Development of the prototype Functional Analysis Development of a template and prototype Conclusions Next Steps www. Process for the development of ELD tool
Objectives of the project responding to the issues raised by the Evaluation Study on the implementation of the ELD addressing the following three barriers to the full implementation of the ELD and to reaching its objectives: Insufficient evidence base for evaluation - there is a need for a register; Lack of clarity regarding key concepts; Lack of knowledge on the ELD at national level. Task 1, Task 2 and Task 3 of the project respond to these three barriers. www. Milieu.be
4
Process for the development of ELD IT tool
Objectives of Task 1 ELD REFIT evaluation report concludes that the relatively lack of data on ELD cases and incidents in Member States is linked to the lack of national ELD registries in the majority of Member States. Task 1 aims at: ensuring that appropriate data and information on ELD cases and ELD implementation is collected at national and EU levels through an ELD tool/Registry. implementing a mock-up to assess the feasibility of a tool for the reporting, gathering and exploration of ELD implementation data. The ELD IT tool will encourage the collection and sharing of information on environmental incidents to improve implementation and to enable evaluation of ELD www. Milieu.be

Establishment of the conceptual framework taking into account REFIT report of ELD and composed of: Definition of ELD objective Definition of full implementation of ELD objective: meaning/indicators (Assessment framework) Definition of project tasks responding to barriers www. Milieu.be

Process for the development of ELD tool
Establishment of the conceptual framework : Definition of ELD objective Environmental damage (incl ELD case); assessment ELD regime – definition of operator and damages Notification of damage and liability Definition of type of liability Preventive and remedial measures taken Compensatory remediation (interim loss pending full recovery) Financial securities applicable www. Establishment of the assessment framework with indicators Objectives Judgement criteria Evaluation criteria Indicators Sub-indicators General objective To prevent and remedy environmental damage Objectives of the Directive are still relevant Relevance Incidents of damage to environment (E) Biodiversity damage Water damage Soil damage Air damage Other types of damages to the environment Liability cases for environmental incidents under national administrative, civil and criminal law (U) Administrative law Civil liability law Criminal law The ELD incidents are identified (they are significant) Environmental damage is prevented or remediated Relevance / Effectiveness ELD cases (significant damage) (E) To establish a framework of environmental liability based on the ‘polluter-pays' principle, The operators carrying hazardous activities take measures and pay for damages caused Effectiveness / Efficiency Cases where the operator takes action and pays for the damage (U) - Defences applied (E) Type of liability (E) Fault based Strict liability (per each ELD Annex III activity) www. Milieu.be

Process for the development of ELD tool
Establishment of the assessment framework with indicators Objectives Judgement criteria Evaluation criteria Indicators Sub-indicators Specific objective Ensure prevention of environmental damages Member States progress towards achieving the objectives set out in the Directive Preventive measures adopted in cases of imminent threat to the environment are adopted and avoided damage Effectiveness Cases where preventive measures applied avoided damage (E) Environmental management systems used Environmental management systems not used Cases where preventive measures applied did not avoid damage (E) Ensure full remediation of environmental damages including for interim loss of resources Remedial measures are adopted to ensure full recovery Cases where remedial measures adopted ensure full recovery (E) Primary remediation Primary and complementary remediation Compensatory measures for interim losses Time to ensure full recovery www. Desk research Table of information with Quantitative information on incidents of environmental damage and on ELD cases Qualitative information on whether specific ELD indicator is recorded and available to public Summary document of data sources in MS Table presenting type of data sources in MS Only few Member States have such registries, e.g. EL, LV, PT. Others, e.g. FR, gather information through other registries (ARIA database) www. Milieu.be

Conclusions Conclusions Lack of data is an issue
Member States involvement did not allow to obtain more info in the mock up Potential for future use / easy to input existing information and manage the content Potential for future use by MS and promoting decentralised data collection Envisaged as a hub on MS geographical information on the environment supported by INSPIRE Directive compliancy Envisaged to be an Open Source tool to be authorised and used by MS as a national information system www.
