P.L – Indian Self-Determination and Education Assistance Act (ISDEAA) and amendments (P.L ) P.L – Native American Housing Assistance and Self- Determination Act (NAHASDA) P.L – Tribally Controlled Schools Act if inclusive of Section 2507 (a)(6) Leasing (GSA Fleet) Must have SPECIFIC reference to interagency motor pool or GSA Fleet vehicle leasing program GSA Fleet is in the process of reviewing its eligibility agreements and making sure that we have all the proper paperwork in order. As we move through this process, agencies that work with tribal entities may need to provide their assistance to the tribes in explaining the requirements and what needs to be in place in order for tribal entities to use GSA Fleet. We are happy for the opportunity to speak with you today and the focus of our presentation is to clarify those requirements and ensure a common level of understanding. It is important to note that GSA Fleet supports Federal entities (and Tribal entities) with two major programs…. Vehicle Purchasing and Vehicle Leasing. The statutory references that allow tribal entities to access GSA Fleet for Purchasing and Leasing are different, so we will be focus on clearly establishing the correct authorities to reference by type of service sought… either purchasing a vehicle or leasing a vehicle from GSA Fleet. As stated in the GSA Tribal Desk Reference (January 2017 edition) the only current cited authorities that allow access to GSA as a source of supply are those listed in GSA Order I - ISDEAA and NAHASDA. PL is listed as it may reference provisions of ISDEAA and thus gain access to GSA as a source of supply For leasing ONLY ISDEAA is a valid authority, IF a specific reference to Fleet is included. The standard template for 638 contract/compact/coop agreement has the appropriate references (Sect 1 for authority and Sect 10, typically, for access to interagency motor pool).

4 Valid Authorities GSA Order 4800.2I (July 19, 2016) Section 7d(5)(a):
(a) The Indian Self-Determination and Education Assistance Act (ISDEAA). As provided in section 102(13) of Pub. L (the Indian Self Determination Act Amendments of 1994) a tribal organization, when carrying out a contract, grant or cooperative agreement under the Indian Self-Determination and Education Assistance Act, is deemed an executive agency for purposes of 40 U.S.C. § 501 (See 25 U.S.C. § 450j(k)). Additionally, each Indian tribe or tribally designated housing entity and each employee of the Indian tribe or tribally designated housing entity shall have access to sources of supply on the same basis as employees of an executive agency. If the self·determination contract contains a provision authorizing interagency motor pool vehicles and related services, as provided in Section 103 of the Indian Self-Determination Act Amendments of 1994, the tribe or tribal organization is eligible to use GSA Fleet motor vehicles and related services, if available (See 25 U.S.C. § 450L). It may be worth pointing out that GSA and other Executive Agencies have historically referred to DOI/IHS/HHS as “sponsoring” agencies when it comes to supporting tribal entities. Technically that is incorrect. When a tribal entity seeks to use GSA as a source of supply, GSA must treat them as an executive agency. The key takeaway here is that agencies such as DOI MUST REFERENCE the appropriate authority in the underlying agreement, compact or contract. This reference is what allows GSA to consider the tribe an executive agency.

5 Leasing Per GSA Order 4800.2I:
ISDEAA is only current valid authority granting access Contract, compact, or grant language MUST have specific reference to interagency motor pool or GSA Fleet leasing Must have valid current and forward looking period of performance (as documented in a funding agreement) P.L , even with reference to 25 U.S. Code § 2507(a)(6), does NOT grant access to vehicle leasing References section 501 of Title 40 – which is GSA as a source of supply Access to Fleet is governed by section 602(c) of Title 40 As mentioned before, only a contract, compact, or grant that cites ISDEAA as their underlying authority - and that ALSO includes a specific reference to vehicle leasing - authorizes tribal access to GSA Fleet. PL commonly found as the cited authority for BIE grants - does NOT meet this requirement. Even if it adds the provisions of 25 USC 2507 [specifically (a)(6)] the grantee does not have access to GSA Fleet leasing. It is possible for additional authorities to be added to the GSA Order. However, they must be reviewed by both OGC and OGP. [WHAT ELSE TO SAY ABOUT WHAT WOULD BE NEEDED HERE - Peter?!?!?] If grants, contracts, or compacts have been issued with the incorrect authority or without specifically mentioning the intent to grant access to GSA Fleet as a source of supply, a modification to update the grants/contracts/compacts/agreements will be required. We would need the agency issuing the document to process the modification and ensure inclusion of the appropriate authority and/or references. If the modification does not occur, GSA Fleet would be placed in the position of working with the Tribal Entity and the agency that issued the Contract, Grant, or Compact to collect the vehicles and end the leasing arrangement. In that situation, we will do everything we can to ensure a smooth transition.

6 Leasing Model Agreement (25 U.S.C. § 450L(c))
(1) AUTHORITY.—This agreement, denoted a Self-Determination Contract (referred to in this agreement as the ‘Contract’), is entered into by the Secretary of the Interior or the Secretary of Health and Human Services (referred to in this agreement as the ‘Secretary’), for and on behalf of the United States pursuant to Title I of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) and by the authority of the tribal government or tribal organization (referred to in this agreement as the ‘Contractor’). The provisions of title I of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) are incorporated in this agreement. (10) TRANSPORTATION.—Beginning on the effective date of this Contract, the Secretary shall authorize the Contractor to obtain interagency motor pool vehicles and related services for performance of any activities carried out under this Contract.
