Timing Article 50 – Treaty on European Union – EU Treaties cease to apply from when withdrawal agreement takes force or, failing that, two years after the notification unless European Council agrees unanimously to extend this period. But when will the notification be given? UK has to agree terms of withdrawal and also replacement agreements. UK has to prepare necessary changes to domestic legislation. A disorderly exit? Human Rights Most Human Rights come from Common Law and Human Rights Act / European Convention on Human Rights. These will continue – until amended by proposed British Bill of Rights. Some human rights protection from EU Charter of Fundamental Rights will cease to apply following BREXIT unless agreed otherwise. Narrower range of protected rights? Workers End to EU freedom of market for labour across member states.
But joining EEA and EFTA continues free movement rights for workers Social Care Workers – 6% or 80,000 of care workers are from other EU countries. Other EU unskilled manual workers- same visa restrictions as non EU countries Workers rights are heavily affected by EU legislation e.g. Working Hours, TUPE, Equal Treatment Main title and body text type levels. Procurement and State Aid
Probably little change in short term; EU procurement rules are adopted into UK law so remain until repealed or replaced European Free Trade Association Rules World Trade Organisation Agreement. Economy and Investment
EU membership – Core Cities estimate this has created over 63,000 jobs, protected at least 16,800 others and provided £1.8bn of infrastructure investment Post Brexit -No access to EU grant funding and questionable if UK has continuing access to European Investment Bank finance. Economic effect on rural areas- 50% of farmers incomes from EU via CAP. Housing- downgrading of UK; fall in house prices, effect on social housing and investment by councils in housing to increase their sources of income Main title and body text type levels. Environment and Planning
Planning – little effect on pure Development Control. Bigger effect on Environment – EU treaties and regulations which are already applicable will cease to apply unless in UK legislation Environmental Impact Assessment – now in domestic legislation, apart from new EIA If Britain joins European Economic Area most EU environmental law will apply. International protocols e.g. Kyoto will continue. Impact on potential future developments when there is uncertainty about what may be required ? Main title and body text type levels.
