NOTE: Before presenting this lesson, instructors must thoroughly prepare by studying this lesson and indentified reference materials. Throughout this lesson, solicit from students the challenges they experienced in the current Operational Environment (OE) and what they did to resolve them. Encourage the students to apply at least 1 of the 8 critical variables: Political, Military, Economic, Social, Information, Infrastructure, Physical Environment, and Time. MOTIVATOR. Line of duty determinations are essential for protecting the interest of both the individual concerned and the U.S. Government where service is interrupted by injury, disease, or death. Soldiers who are on active duty (AD) for a period of more than 30 days will not lose their entitlement to medical and dental care, even if the injury or disease is found to have been incurred not in LD and/or because of the soldier’s intentional misconduct or willful negligence. Terminal Learning Objective
ACTION: Manage Line of Duty Investigations CONDITION: Given a requirement to manage LOD investigations and access to AR and awareness of Operational Environment (OE), variables, and actors. STANDARDS: The student will meet the standards when they accurately: 1. Define LOD investigations and their uses. 2. Identify basic guidelines and procedures for managing LOD investigations. 3. Identify S-1 responsibilities in LOD investigations. SHOW SLIDE: TERMINAL LEARNING OBJECTIVE SAFETY REQUIREMENTS. In a training environment, leaders must perform a risk assessment in accordance with FM 5-19, Composite Risk Management. Leaders will complete a DA Form 7566 COMPOSITE RISK MANAGEMENT WORKSHEET during the planning and completion of each task and sub-task by assessing mission, enemy, terrain and weather, troops and support available-time available and civil considerations, (METT-TC). Note: During MOPP training, leaders must ensure personnel are monitored for potential heat injury. Local policies and procedures must be followed during times of increased heat category in order to avoid heat related injury. Consider the MOPP work/rest cycles and water replacement guidelines IAW FM , NBC Protection, FM , CBRN Decontamination. No food or drink is allowed near or around electrical equipment (CPU, file servers, printers, projectors, etc.) due to possible electrical shock or damage to equipment. Exercise care in personal movement in and through such areas. Avoid all electrical cords and associated wiring. In event of electrical storm, you will be instructed to power down equipment. Everyone is responsible for safety. RISK ASSESSMENT LEVEL. Low. ENVIRONMENTAL CONSIDERATIONS: Environmental protection is not just the law but the right thing to do. It is a continual process and starts with deliberate planning. Always be alert to ways to protect our environment during training and missions. In doing so, you will contribute to the sustainment of our training resources while protecting people and the environment from harmful effects. Refer to FM Environmental Considerations and GTA ENVIRONMENTAL-RELATED RISK ASSESSMENT. EVALUATION. There is no evaluation for this block of instruction. INSTRUCTIONAL LEAD-IN. Line of duty determinations are essential for protecting the interest of both the individual concerned and the U.S. Government where service is interrupted by injury, disease, or death. Soldiers who are on active duty (AD) for a period of more than 30 days will not lose their entitlement to medical and dental care, even if the injury or disease is found to have been incurred not in LD and/or because of the soldier’s intentional misconduct or willful negligence. A person who becomes a casualty because of his or her intentional misconduct or willful negligence can never be said to be injured, diseased, or deceased in LD. Such a person stands to lose substantial benefits as a consequence of his or her actions; therefore, it is critical that the decision to categorize injury, disease, or death as not in LD only be made after following the deliberate, ordered procedures described in this regulation.

Requirements for an LOD
What medical situations require an LOD investigation? Hospitalization Injury from motor vehicle accident Fractures (ankle, finger,wrist, hand) Head injury (concussion) Strains and Sprains (neck, back, knee) Joint injuries (hip, knee, shoulder) Allergic reactions (bee sting, poison ivy, etc.) Disease EPTS conditions Directed or requested In all other cases of death or injury, except injuries so slight as to be clearly of no lasting significance (for example, superficial lacerations or abrasions or mild heat injuries), an LOD investigation must be conducted. Personnel Policy Guidance (PPG)
Published by the Army G-1 for personnel who are activated, mobilized, employed, or deployed in support of contingency operations. Chapter 9 (Casualty Operations) of the HQDA PPG provides exceptions to current LOD processing policy. Informal LOD An informal investigation should be performed in cases where: the Soldier's injury/illness is not a result of misconduct or negligence did not happen under doubtful circumstances documentation clearly defines the who, what, why and how of the injury/illness. SHOW SLIDE: INFORMAL LOD

Processing Informal LOD

Processing Formal LOD Step Performed By Completion
1. Complete 5 copies of Section I Statement of Medical Exam and Duty Status (DA Form 2173). 2. Request DA Form 2173 from MTF if not previously received. 3. Complete Section II, DA Form 2173, attach supporting documents, and send original and two copies to the appointing authority for units in the area where the incident occurred. 4. Appoint, by memo, a disinterested officer to conduct the investigation. 5. Conduct a formal investigation and make a report on investigation on DD Form 261. 6. Review the investigation, complete the block titled "Action by Appointing Authority" on DD Form 261. 7. Review the investigation, complete the block titled "Action by the Reviewing Authority" on DD Form 261. 8. Review the investigation and enter the official designation of the HQs, the date, approval or disapproval of the findings, and signature. Determination Memorandums
Presumptive ILD/LOD Determination Memorandums Intent - used to expedite LOD determinations for Soldiers being REFRAD who would not otherwise receive an LOD (informal or formal) prior to REFRAD under current policy. Presumptive ILD determination memorandum cannot be used to render an adverse LOD determination; a formal LOD must be conducted to render an adverse LOD determination. Presumptive ILD memos are authorized when all of these conditions are met General Officers and MTF commanders (or their delegates) are authorized to issue presumptive ILD determination memorandums. Presumptive ILD determinations are made based on review of Soldier's medical record by qualified personnel. LOD Module - National Guard
The Line of Duty (LOD) module provides a web-accessible comprehensive, user-friendly tool for use at Units, JFHQ-S, and National Guard Bureau to administer and manage LOD determinations, incapacitation pay, medical care, and safety programs.
