What exactly is Operator Training?
Operator training is a three-tiered training program (Class A, B, and C) required by federal law in New Jersey for the operation of Underground Storage Tanks (USTs). The purpose of the training program is to ensure that owners and operators of USTs properly operate and maintain UST systems.

When did Operator Training begin?
Federal EPA implemented Operator Training August of 2012 New Jersey adopted new rules January 2018 You must have Operator Training implemented at your location by October 13th, 2018

After October 2018 operators must be trained as follows:
Class A and Class B operators must be trained within 30 days after assuming operation and maintenance responsibilities at the underground storage tank system. Class C operators must be trained before designation and assuming responsibility for responding to emergencies. Owners and operators can designate themselves as Class A/B/C operators or they can designate contractors or employees. If contractors or employees are designated, the UST system owners and operators still retain liability for all regulatory issues, including ensuring their Class A, B, and C operators have received the required training and passed the applicable examinations.

Class A Operator Usually the Owner
Primary Responsibility to oversee the operation and maintenance of the UST system Managing Resources and Personnel, establishing work assignments, and maintaining compliance with Regulatory Requirements

Class A Operator For example, this individual typically ensures that appropriate individual(s): Properly operate and maintain the underground storage tank system. Maintain appropriate records He/She is trained to respond to emergencies caused by releases or spills from underground storage tank systems at the facility. Make financial responsibility documents available to the implementing agency as required.

Class B Operator May be the Owner, Operator, Manager, and Gas Attendant. Class B Operator “implements” all applicable UST regulatory requirements for the UST system. This individual implements the day-to-day aspects of operating, maintaining, record keeping for the UST.

Class B Operator For example, this individual typically monitors, maintains, and ensures: Release detection method is performed for tanks and product piping Cathodic protection method is functional Release prevention equipment (overfill and spill protection) is functioning Recordkeeping, and reporting requirements are met. All relevant equipment complies with performance standards. Appropriate individuals are trained to properly respond to emergencies caused by releases or spills from underground storage tank systems at the facility.

Class C Operator Who is the Class C Operator? Owner – Manager Usually the Gas Attendant & Gas Pumper Responsible for dispensing the fuel. Is responsible for initial response to alarms or releases. MUST KNOW how to re-act in an Emergent Situation!! NJDEP Compliance Officers will check his/her understanding of his/her role and their ability to respond to emergency situations at your location!!

Training the Class C Operator
The Owner and Operator shall determine the appropriate method of training each Class C operator at a facility, provided that the training meets the requirements at N.J.A.C. 7:14B-5A.2(c).

Class C Training Instruction on how to appropriately respond to emergencies presented by spills or releases resulting from the operation of the UST system that pose an immediate danger or threat to the public or to the environment AND notify the appropriate authorities.

Class C Training The appropriate actions and responses to alarms associated with release detection equipment or the UST system

Class C Training An evaluation of the trainee’s understanding of his or her role, and ability to perform the appropriate response actions for spills or releases and alarms associated with release detection equipment. A trainee shall satisfactorily demonstrate relevant knowledge and ability to the person conducting the training before he or she may be designated a Class C operator under N.J.A.C. 7:14B-5.14.

Retraining If the Department determines that an UST system is out of compliance with a significant requirement (for example, not having operating leak detection or cathodic protection mechanisms, failing to respond to alarms or active discharges) or repeatedly violating the same requirements over multiple inspections. The Department will require retraining and retesting (as applicable) of the designated Class A and/or Class B operators of the UST system in accordance with N.J.A.C. 7:14B-5A.2. Retraining must be completed no later than 30 days from the date the Department advises the facility of significant or repetitive non-compliance, or within an alternate timeframe as agreed to by the Department. The Department may, at its discretion, provide an exception from the retraining described above, if the Department determines that the UST system’s non- compliance on which the retraining determination is based appears to have resulted from unanticipated equipment failure, improper contractor repairs, or other factors beyond the normal control and diligence of the owner and operator.

Documentation of Training Requirements
The Owner and Operator shall maintain records that document the training and retraining, if applicable, received for each designated Class A/B/C operator. The records for each operator shall be maintained for as long as the operator is designated for the facility. The training records shall be maintained on paper or electronically, and shall be made available for on-site inspection by the Department upon request.

Documentation of Training Requirements
The training record must include at a minimum: Identify each Class A/B/C operator for the facility; the persons name, the operator training he or she completed, date(s) of initial training and any retraining training (if applicable), and the trainer’s name and contact information; The name and signature of the trainer for classroom or field training programs (including Class C operator training provided by the Class A or Class B operator); Indicate the name of the computer based training program and web address (if internet based); and Include the subjects on which the Class A or Class B operator completed retraining, if applicable.

Designation of a Class A, Class B, or Class C operator does not relieve an Owner and Operator of responsibility for compliance with the State Act, and this chapter.

Unmanned Facilities Facilities that receive after-hours deliveries can: Schedule with supplier to have a Class C operator onsite for delivery OR Post signs that meet the requirements for an unmanned facility.

Sign Information Signs must be clearly visible and weather resistant
List procedures to be followed in the event of a leak or discharge of a hazardous substance; including the procedures to address alarms associated with release detection equipment
