Reasonable Accommodations
Regulations It is the policy of the U.S. Department of Homeland Security and the U.S. Coast Guard (USCG) to comply fully with the requirements of the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 791 et seq. The Equal Employment Opportunity Commission (EEOC) has issued regulations at 29 C.F.R. Part 1630 implementing the provisions of the law for federal agencies. The U.S. Coast Guard reasonable accommodation procedures are located in Commandant's Instruction C, Civil Rights Manual, Chapter 5. Regulations (cont.) No qualified individual with a disability may be denied the benefits of any programs, training, or activities conducted, sponsored, funded, or promoted by USCG due to discrimination. Reasonable Accommodations will be provided to all qualified individuals with disabilities, unless doing so poses a direct threat to the requester, other employees, or impose an undue hardship on USCG. How to request a reasonable accommodation An employee or applicant or his/her representative must inform the manager that he/she needs an adjustment or change at work for a reason related to a medical condition. Generally, the employee must ask; There are no “magic words” and it can be in Plain English; and The request does not have to be in writing, but the submission of CG form 6079 is highly encouraged. How to handle the request for a reasonable accommodation Once a request is presented, the manager should immediately acknowledge receipt (CG-6080 form) and begin an interactive dialogue with the requestor, during which they may discuss: The limitations associated with the medical impairment at issue; The frequency and duration of any limitations associated with the medical impairment at issue; The type of accommodation is being requested; How would the accommodation assist with performing the essential functions of the job; Alternative accommodations; and Who will serve as the “decision maker”. How to handle the request for a reasonable accommodation When a disability and/or the need for reasonable accommodation is not obvious, or otherwise already known, the employee may be asked to submit sufficient medical documentation about the disability associated limitations. If a “decision maker” believes that medical information is necessary, it is appropriate to seek assistance before proceeding from the following resources: The Civil Rights Directorate, The Computer/Electronics Accommodations Program, The Department of Transportation Disability Resource Center, or The Office of General Counsel All medical information is privacy protected and must be secured. How to handle the request for a reasonable accommodation The decision maker must complete the following forms and submit them to the servicing civil rights office: Approved accommodation requests: Form CG-6079 Denied accommodation requests: CG-6081 An accommodation should only be denied if : The individual is determined not to have a disability, as defined under the Rehabilitation Act. The person cannot perform the essential functions of the job with or without an accommodation, and reassignment efforts were unsuccessful. The accommodation creates an undue hardship. Denied reasonable accommodation requests must be communicated to the requestor in writing, with an explanation for the denial. How to handle the request for a reasonable accommodation The Appeal Process: When a decision maker denies a request for reasonable accommodation, the employee may make a request for reconsideration. If the request is denied, the employee can appeal the denial, in writing, to the Civil Rights Directorate, People with Disabilities Program Manager.
