Nine Findings Legal Safeguards/Access has created a system focused on compliance not quality Antiquated model of failure rather than prevention General Education and Special Education share responsibilities for children with disabilities and they should not be separable at any level: identification, instruction or cost Parents need to be empowered and have choices

Nine Findings Culture of compliance has diverted resources to litigation Current methods of identifying children with disabilities lack validity (LD) Need for highly qualified teachers Special Education research needs enhanced rigor and long term coordination Focus on academic achievement and social outcomes

Eligibility Changes: LD
Learning Disability (LD): achievement and IQ discrepancy model (the “wait to fail model”) cannot be mandated by the SEA Schools may use Response to Intervention (RTI) model for LD eligibility determination

IEP Requirements Participation in Statewide Assessment determined and documented in IEP Accommodations determined and documented in IEP Measurable annual goals include academic and functional goals (PLAAFP) Students assessed on alternate achievement standards also have short-term objectives in IEP Secondary Transition Services linked to measurable post-secondary outcomes Course of study, career/employment training and independent living assessments linked to post-secondary outcomes

DID YOU KNOW? That IDEA (since 1998) has required ALL students with an IEP to be assessed using state and district-wide assessment?

DID YOU KNOW That the Elementary and Secondary Education Act (ESEA) states Section “A state’s academic assessment must provide for the participation of all students in the grades assessed.” AND “…provide one or more alternative assessment for students with disabilities as defined in IDEA.
