Cost of Lands & Properties Required for Right of Way
Includes permanent right of way and permanent or temporary easements Land and land improvements – taken or damaged by taking Owner’s appraisal fees Up to maximum limits allowed by Minnesota Statute Subd. 2 (b) The owner must submit a copy of the owner’s appraisal, at least 5 days before a condemnation commissioner’s hearing. Maximum of $1,500 for single family & two-family residential property and minimum damage acquisitions (property that can be acquired for $25,000 or less) Maximum of $5,000 for other types of property

Appraisal costs to the local road authority Consultant services Local agency staff for market research and document preparation Title Issues Costs to bring abstract up to date for reasons of CURRENT purchase. Cannot be for correction or updating of missing data or transactions Filing Fees, Record Deed or Mortgage Satisfaction (unpaid balance of mortgage principal) State Deed Tax

Relocation and Moving Costs
Residential - Owner/Occupant – Total Acquisition Utility - Payment to utility companies for utility relocation required by construction Must be on the land being purchased If on the existing right of way by permit, the utility company is required to move without reimbursement of payment. Railroad – Payment to railroad for facility relocation required by construction Railroad must be on the land being purchased If the railroad is on the existing right of way by permit, the railroad is required to move it’s facility without reimbursement or payment Demolition Expenses

Right of Way Damages to Other Land if Justified
Clean up contaminated site Bill to owner and reimbursement is to go to the State Aid Account Title Searches For consultant services Local agency staff for document research and document prep Condemnation Costs Trial Expenses – Does not include staff Attorney’s fees

Abstract Updating – for property owners to clear issues After the Fact needs on Trunk Highway Projects Permits Taxes Work by local forces to complete negotiations Eligible for Preliminary Engineering and NOT Right of Way: Archaeological Digs Staking of Right of Way Investigation of Contaminated Site
