May 2010 Some Terms WG - Working group – responsible for developing standards in an area TAG – Technical Advisory Group – experts on a topic area that crosses working groups – may develop a recommended practice. Task group or task force – a part of a working group which focuses on a particular project. Study group – a part of a working group which focuses on writing PARs and 5Cs PAR – project authorization request – the document that authorizes work on a project. 5C – The Five Criteria. Defines 1.) the broad market potential, 2.) Compatibility, 3.) Distinct Identity, 4.) Technical Feasibility, and 5.) Economic Feasibility of a proposed PAR CA – Coexistence Assurance document. Any wireless project must submit one of these to prior to letter ballot. IEEE SA Patent Policy Advise the WG attendees that:
May 2010 Advise the WG attendees that: The IEEE’s patent policy is consistent with the ANSI patent policy and is described in Clause 6 of the IEEE-SA Standards Board Bylaws; Early identification of patent claims which may be essential for the use of standards under development is strongly encouraged; There may be Essential Patent Claims of which the IEEE is not aware. Additionally, neither the IEEE, the WG, nor the WG chair can ensure the accuracy or completeness of any assurance or whether any such assurance is, in fact, of a Patent Claim that is essential for the use of the standard under development. Instruct the WG Secretary to record in the minutes of the relevant WG meeting: That the foregoing information was provided and that slides 1 through 4 (and this slide 0, if applicable) were shown; That the chair or designee provided an opportunity for participants to identify patent claim(s)/patent application claim(s) and/or the holder of patent claim(s)/patent application claim(s) of which the participant is personally aware and that may be essential for the use of that standard Any responses that were given, specifically the patent claim(s)/patent application claim(s) and/or the holder of the patent claim(s)/patent application claim(s) that were identified (if any) and by whom. The WG Chair shall ensure that a request is made to any identified holders of potential essential patent claim(s) to complete and submit a Letter of Assurance. It is recommended that the WG chair review the guidance in IEEE-SA Standards Board Operations Manual and in FAQs 12 and 12a on inclusion of potential Essential Patent Claims by incorporation or by reference. Participants, Patents, and Duty to Inform
May 2010 Participants, Patents, and Duty to Inform All participants in this meeting have certain obligations under the IEEE-SA Patent Policy. Participants: “Shall inform the IEEE (or cause the IEEE to be informed)” of the identity of each “holder of any potential Essential Patent Claims of which they are personally aware” if the claims are owned or controlled by the participant or the entity the participant is from, employed by, or otherwise represents “Personal awareness” means that the participant “is personally aware that the holder may have a potential Essential Patent Claim,” even if the participant is not personally aware of the specific patents or patent claims “Should inform the IEEE (or cause the IEEE to be informed)” of the identity of “any other holders of such potential Essential Patent Claims” (that is, third parties that are not affiliated with the participant, with the participant’s employer, or with anyone else that the participant is from or otherwise represents) The above does not apply if the patent claim is already the subject of an Accepted Letter of Assurance that applies to the proposed standard(s) under consideration by this group Quoted text excerpted from IEEE-SA Standards Board Bylaws subclause 6.2 Early identification of holders of potential Essential Patent Claims is strongly encouraged No duty to perform a patent search Slide #1 Bob Heile, ZigBee Alliance

Other Guidelines for IEEE WG Meetings
May 2010 Other Guidelines for IEEE WG Meetings All IEEE-SA standards meetings shall be conducted in compliance with all applicable laws, including antitrust and competition laws. Don’t discuss the interpretation, validity, or essentiality of patents/patent claims. Don’t discuss specific license rates, terms, or conditions. Relative costs, including licensing costs of essential patent claims, of different technical approaches may be discussed in standards development meetings. Technical considerations remain primary focus Don’t discuss or engage in the fixing of product prices, allocation of customers, or division of sales markets. Don’t discuss the status or substance of ongoing or threatened litigation. Don’t be silent if inappropriate topics are discussed … do formally object. May 2010 Declaration of Affiliation Required Revision: Feb 2006 Standards Board Bylaw Openness Openness is defined as the quality of being not restricted to a particular type or category of participants. All meetings involving standards development an all IEEE Sponsor ballots shall be open to all interested parties. Each individual participant in IEEE Standards activities shall disclose his or her affiliations when requested. A person who knows or reasonably should know, that a participant’s disclosure is materially incomplete or incorrect should report that fact to the Secretary of the IEEE-SA Standards Board and the appropriate Sponsors. May 2010 Declaration of Affiliation * Disclosure of Affiliation: During 2006, the IEEE-SA Board of Governors and the IEEE-SA Standards Board recognized that making visible those interests that are funding participation in Working Groups and Sponsor ballots would improve transparency and openness in IEEE-SA standards development. In December 2006, changes to the IEEE-SA Standards Board Bylaws and the IEEE-SA Standards Board Operations Manual were approved to make the Declaration of Employer and Affiliation mandatory in various IEEE-SA activities. In support of this requirement, myProject is collecting Declaration of Employer at the personal level (via myInfo) and Declaration of Affiliation at both the project and Sponsor ballot levels (via the Technical Activity Area selection process). The Declaration of Employer at the personal level was implemented in early February 2006 and those who have logged into myProject since then have been directed to provide their Employer as a mandatory field within their contact information before being allowed to go further into the system. Effective 2 April 2007, the same direction apply for Declaration of Affiliation at the Sponsor, Working Group, and Project levels. A complete set of FAQs (definitions of Employer and Affiliation; what will be done with the information; the consequences of not providing information or of providing erroneous data; etc.) is also available. May 2010 Becoming a Voter-Overview Earned by attending and participating in meetings for each session in progress. Two (2) types of meeting sessions Plenary:….3 sessions per calendar year (March, July, November) Organized by IEEE 802 Interim: .. Currently 3 sessions per calendar year (January, May, September) Organized by working group IEEE /15/18/19/22 Voting rights can be earned by participation in 2 of the last 4 consecutive plenary sessions. An interim may be substituted for a plenary as long it falls in the time window of the last 4 consecutive plenaries. When you reach “Nearly Voter” status, depending on working group, you may be required to submit a letter of intent requesting voting rights to the WG Chair and coping the WG Vice-Chair by 14 days prior to the next plenary session to be granted voting rights at that next session. Please check with the Working Group Chair or Vice Chair to see if this is required.Voting rights are only granted in “Plenary Sessions” Definition of participation….. Must be present in for at least 75% of a meeting in at least 75% of ALL time slots in a session and voters attending will receive voting credit for maintaining voting rights in or (primary WG) Bob Heile, ZigBee Alliance
