McCulloch v. Maryland Definition First decision by the Supreme Court (SC) to declare a law unconstitutional (1803). Gave the federal government control over states when laws conflicted. Defined the powers of a state over the federal government. Facts John Adams made many federal appointments at the end of his term, including making Marbury justice of the peace in Washington DC. The new president, Jefferson, refused to recognize this appointment when he took office and directed his secretary of state, Madison, not to deliver Marbury notice of his appointment. Marbury sued Madison and the SC took the case. They ruled that a previous law (the Judiciary Act of 1789) which spelled out the practice of delivering notices for appointments was unconstitutional. New York legislature passed a law giving monopoly on steamship travel. Gibbons, another steamship trader wanted to use NY waters for his business, too, and had been given federal permission. NY denied his request, so he sued. SC decided that the federal gov’t could regulate commerce and trade and ruled in favor of Gibbons. US had a federal bank. Maryland voted to tax all bank business not done with state banks, including the federal bank. McCulloch worked in the Baltimore branch of the US Bank and refused to pay the tax, so Maryland sued him. SC ruled that the federal gov’t had the right to set up a bank and that the states did not have the right to tax the federal gov’t. Constitution Article III Article I, Section 8 Significance 1st time the SC struck down a law because it was unconstitutional; the beginning of the practice of "judicial review." The presidency of thomas jefferson
I can explain major events that occurred during Thomas Jefferson’s presidency including 1the election of 1800 and 2the Louisiana Purchase.

1. The revolution of 1800 Jefferson thought of his election as the “Revolution of 1800.” He barely won the presidency because he and another candidate, Aaron Burr, received 73 electoral votes. It was up to the House of Representatives to decide who would be president. They were deadlocked for six days and voted 35 times. On the 36th vote, the House of Representatives elected Jefferson as president.

Jefferson’s main goal was to limit the federal government’s power over states and citizens.
He believed that under Washington and Adams, the federal government had become too involved in economic affairs. He believed in the term “laissez faire,” which means that the government should not interfere in the economy.

Jefferson drastically reduced the number of people in government.

2. The louisiana purchase
Farmers living between the Appalachian Mountains and the Mississippi River needed access to the Mississippi so that they could ship their goods to the Port of New Orleans and to the East. The Pinckney Treaty secured this port for the US, but in 1801, Jefferson discovered that Spain had secretly given New Orleans and the rest of its Louisiana Territory to France. Jefferson was afraid that Napoleon Bonaparte, France’s ruler, would try to conquer the US.

Jefferson sent two ambassadors to France to negotiate a deal so that the US could purchase the Port of New Orleans and secure it for US trade and commerce. France surprised the US with a proposition: BUY the Port of New Orleans and the entire Louisiana Territory for $15 million.

This would be a HUGE bargain for the US.
Its area almost doubled the size of the country. Ownership of the Louisiana Purchase gave the US control of the Mississippi. Jefferson had long argued that the federal government’s powers were limited to what was set down in the Constitution. The Constitution did not specifically give the government the power to buy land from a foreign country. When France offered over 800 million acres to the US for purchase, how do you think Jefferson responded?

In the end, Jefferson decided that he did have the authority to buy Louisiana.
His reasoning was that the Constitution allowed the President to negotiate treaties and this was part of a treaty/agreement between the US and France. The Senate approved the treaty and Congress quickly voted to pay for the land. Why did President Jefferson hesitate to approve the purchase of the Louisiana Territory?
