US – REGSFAKULTEIT: DECIDED TO DO SOMETHING ABOUT THIS CRITICISM BECAUSE WE WANT TO DELIVER LAWYERS WHO CAN READ LIKE LAWYERS, THINK LIKE LAWYERS AND CAN WRITE LIKE LAWYERS. STUDENTS ALSO OFTEN REGAD THE WRITING PROCESS AND THE CRITICAL THINK PROCESS AS MUTUALLY EXCLUSIVE, AND THEREFORE FAIL TO APPRECAITE THAT WRITING IS THE END-RESULT OF A PROCESS OF ARGUMENTATION OR ANALYSIS. STUDENTS OFTEN FAIL TO ENGAGE IN A PROCESS OF EXPLORATORY THINKING, ENABLING THEM TO SUSPEND JUDGMENT AND TO ENTER INTO THE SPIRIT OF OPPOSING VIEWS. THE LAW FACULTY THUS IMPLEMENTED A WRITING STRATEGY GO ADDRESS THE LACK OF CRITICAL THINKING, CALLED THE WRITING ACROSS THE CURRICULUM STRATEGY. LETS ASSUME YOU ARE CONFRONTED WITH A LEGAL PROBLEM OR LEGAL QUESTION IN A TEST OR IN AN EXAM OR IN PRACTICE, WHAT DO YOU FIRST NEED TO DO? YOU WILL FIRST HAVE TO ENGAGE WITH THE LEGAL PROBLEM, BY CRITICALLY READING AND ANALYSING THE PROBLEM. YOU MUST BE ABLE TO IDENTIFY THE LEGAL AND NON-LEGAL ISSUES. YOU MUST BE ABLE TO IDENTIFY THE MOST APPROPRIATE SOURCES OF LAW TO APPLY TO THE LEGAL PROBLEM, BE ABLE TO JUDGE THE DIFFERENT VIEWS ON THE LEGAL ISSUES AND MAKE AN INFORMED CHOICE AS TO WHY YOU PREFER A PARTICULAR SOLUTION TO THE PROBLEM AS OPPOSE TO ANOTHER.

DOEL: VERBANDHOUDENDE INTERVENSIES → SKRYF & NAVORSING = LLB STUD’TE / AIM: INTERRELATED INTERVENTIONS → WRITING & RESEARCH = LLB STUD’S VERBANDHOUDENDE INTERVENSIES: 3 KOMP’E: SV SKRYFGIDS + SKRYFKONSULTANTE & WEBTUISTE: REGSSKRYFWERK / INTERRELATED INTERVENTIONS: 3 COMP’S : WS WRITING GUIDE + WRITING CONSULTANTS & “LEGAL WRITING WEBSITE” THE DIFFERENT COMPONENTS OF THE WRITING STRATEGY ARE IMPORTANT BECAUSE IT BUILDS ON ONE ANOTHER. ACROSS THE DIFFERENT YEAR GROUPS, A NUMBER OF WRING INTENSIVE MODULES HAVE BEEN IDENTIFIED. LATER THIS YEAR YOU WILL FOR EXAMPLE BE REQUIRED TO DO AN ESSAY FOR YOUR CRIMINAL LAW MODULE. THE SKILLS WE WILLL PROVIDE YOU WITH IN THIS MODULE, ARE MEANT TO ASSIST YOU WITH WRITING THAT ESSAY. IN OTHER WORDS, THE READINGS SKILLS FOCUSSED ON DURING THE 1ST SEMESTER ARE MEANT TO HELP YOU WITH CRITICALLY ANALYSING THE LEGAL ISSUE(S) IN THE TOPIC YOU CHOOSE. IN SECOND SEMESTER WE WILL TEACH YOU HOW TO CONSTRUCT A PROPER LEGAL ARGUMENT. = SO WHAT AM I TELLING YOU: REGARDLESS OF YOUR GRADES IN MATRIC, YOU DO NEED TO DO THIS COURSE. AS THIS COURSE FORMS THE BUILDING BLOCKS FOR ALL YOUR FUTURE WRITING INTENSIVE MODULES, LIKE CONSTITUTIONAL LAW 271, ROMAN LAW 271, INTERNATIONAL LAW 341 AND LEGAL SKILLS 411. THIS IS NOT JUST SOMETHING THE LAW FACULTY IN CONJUNCTION WITH THE LANGUAGE CENTRE THOUGHT WOULD BE A NICE TO HAVE, IT IS A NECESSASITY AND YOU ARE BETTER OFF IN DOING THE COURSE.

5 BELANGRIK / IMPORTANT:
Module: werkstuk-georienteerd / Module: assignment-centred Ondersoekende navorsing + skryf / Exploratory research + writing Maak 50% van u finale punt uit. Constitute 50% of the final mark. Alle werkopdragte is verpligtend en studente wat nie betyds inhandig nie, sal 'n punt van '0' vir die betrokke opdrag ontvang. All assignments are compulsory and students who fail to submit in time will be awarded a mark of ‘0’ for the assignment in question. SV 171: BOUSTEEN / WS 171: BUILDING BLOCK As part of the writing component students are taught to draw construct well-reasoned conclusions and solutions, testing them against relevant criteria and standards, justifying their ideas in writing and other appropriate modes.

6 TAAL / LANGUAGE: Taalimplementering in die module vind plaas soos uiteengesit in die fakulteit se Taalimplemen-teringsplan.  Die Taalimplementeringsplan is be-skikbaar op SunLearn asook die fakulteit se webtuiste. / Language implementation in the module takes place in the module as set out in the Faculty’s Language Implementation Plan.  The Language Implementation Plan is available on SunLearn as well as the Faculty’s website. Daar is aparte lesings in Afrikaans en Engels. Studente word in Afrikaans en Engels ondersteun gedurende ’n kombinasie van toepaslike, gefasiliteerde leergeleenthede (byvoorbeeld konsultasies in kantoortyd of normale geskeduleerde tutoriale en praktika). / There are separate lectures in Afrikaans and English. Students are supported in Afrikaans and English during a combination of appropriate, facilitated learning opportunities (e.g. consultations during office hours or routinely scheduled tutorials and practicals).

7 PLAGIARISM: PLAGIAAT / PLAGIARISM: Neem asseblief hierdie oortreding ernstig. Die opdragte sal in die loop van die tweede semester behoorlik geëvalueer word. Oortredings sal hanteer word van die Universiteit Stellenbosch se beleid oor plagiaat (Senaat: 1 Desember 2016). Please take this offence seriously. The assignments will be duly evaluated during the course of the second semester. Infringements will be dealt with terms of the Stellenbosch University Policy on Plagiarism (Senate: 1 December 2016).

8 MEDICAL CERTIFICATES:
The following medical certificates will NOT be accepted/acceptable going forward: medical certificates issued retrospectively – date subsequent to the test / assignment date; and medical certificates indicating that a student was not examined by the medical practitioner at the time of the illness, i.e. the medical practitioner uses the phrase “as I was informed”. Please note that the abovementioned qualifications also apply to a medical certificate that is submitted to excuse an absence from class or a tutorial.
