STATUTORY RAPE (Defined and penalized under the RPC, as amended by RA 8353) RAPE CHILD SEXUAL ABUSE (Violation of R.A. 7610) * Carnal knowledge of a WOMAN under 12 years of age or is demented *Carnal knowledge of a WOMAN using force, threat or intimidation; deprived of reason or otherwise unconscious; and by means of fraudulent machinations or grave abuse of authority * Act of sexual assault by inserting penis into another person’s mouth or anal orifice or any instrument or object into the genital or anal or orifice of another person * Sexual intercourse or lascivious conduct with children (below 18 years of age, whether male or female) who indulge in the said act for money, profit or any other consideration or due to the coercion or influence of any adult, syndicate or group. * Twelve (12) years to below eighteen (18) years of age

STATUTORY RAPE (Defined and penalized under the RPC, as amended by RA 8353) RAPE CHILD SEXUAL ABUSE (Violation of R.A. 7610) Penalty: reclusion perpetua (20 years and 1 day to 40 years *if woman below seven (7) years of age PENALTY: DEATH Penalty: Reclusion Perpetua PENALTY: Reclusion Perpetua to Death: 1. When committed with the use of a deadly weapon 2. When committed by two or more persons 3. The victim became insane 4. When attempted and homicide committed Penalty: Prision Mayor (6 years and 1 day to 12 years) Penalty: Prision Mayor to Reclusion Temporal (6 yrs and 1 day to 12 yrs yrs & 1 day to 20 yrs.) -committed with the use of a deadly weapon - committed by two or more persons Penalty: Reclusion temporal (medium to Reclusion Perpetua) *below 12 years: to be prosecuted under RPC, as amended Penalty for Lascivious Conduct: Reclusion Temporal (medium period) (14 yrs 8 months and 1 day to 17 years & 4 months

(Defined and penalized under the RPC, as amended by RA 8353) RAPE CHILD SEXUAL ABUSE (Violation of R.A. 7610) PENALTY: Death 1. victim under 18 years of age and offender is a parent, ascendant, step-parent, guardian, relative by consanguinity or affinity within the third civil degree, or the common-law spouse of the parent of the victim; 2. victim is under the custody of the police or military authorities or any law enforcement or penal institution; Reclusion Temporal (12 yrs and 1 day to 20 yrs) -victim became insane committed with any of the ten (10) aggravating/qualifying circumstances Reclusion Temporal to Reclusion Perpetuan -when attempted and homicide is committed Reclusion Perpetua -homicide is commited

STATUTORY RAPE (Defined and penalized under the RPC, as amended by RA 8353) RAPE CHILD SEXUAL ABUSE (Violation of R.A. 7610) 8. advantage of his position to facilitate the commission of the crime; 9. victim suffered permanent physical mutilation or disability; 10. offender knew of the pregnancy of the offended party at the time of commission; 11. offender knew of the mental disability, emotional disorder and/or physical handicap of the offended party at the time of the commission of the crime.
