2 Case Summary During World War II, a military commander ordered all persons of Japanese descent to evacuate the West Coast. The Petitioner, Korematsu (Petitioner), a United States citizen of Japanese descent, was convicted for failing to comply with the order.

3 Constitutional Issue contained in case
Korematsu v. United States, case in which on Dec. 18, 1944, the U.S. Supreme Court upheld the conviction of Fred Korematsu—a son of Japanese immigrants who was born in Oakland, Calif.—for having violated an exclusion order requiring him to submit to forced relocation during World War II.

Korematsu v. United States, 323 U.S. 214 (1944), was a landmark United States Supreme Court case concerning the constitutionality of Executive Order 9066, which ordered Japanese Americans into internment camps during World War II regardless of citizenship.
