2. The essential question
Did the President and congress go beyond their war powers by implementing exclusion and restricting the rights of Americans of Japanese descent?

3. Case background information
During the Japanese American war, the President signed Executive order 9066, which allowed military authorities to enact curfews. It also forced Japanese – Americans to sell their homes and belongings and move to internment camps. Fred Korematsu, a Japanese- American and U.S. Citizen, had facial surgery and pretended to be Mexican- American but got arrested for violating an order that banned people of Japanese descent from the area of San Leandro, California.

4. What constitutional principles are related to this case?
Amendment 14- the right to equal protection

5. How did the Court answer the essential question?
The court vote was 6:3 in favor of the United States. They came to the conclusion saying that without the Japanese- Americans in internment camps, the public would be in danger. They also stated that normally forcing citizens to sell their homes is an impermissible use of government power, there is and exception when there is grave danger to public safety.

6. WHAT WAS THE IMPACT OF THIS CASE ON SOCIETY?
Why is this considered a landmark case?
This impacted Japanese- Americans at the time because they had to sell their possessions and move to internment camps.
This is a landmark case because it was about equal protection and if the government was allowed to put all of the Japanese- Americans in internment camps during world war II
