1. BETH YDYW? WHAT IS IT? Ers 2008, mae trosedd â chyllell wedi ei ddiffinio fel unrhyw drosedd sy’n bodloni y ddau faen prawf isod: Yn cyfrif fel trosedd lladdiad, ymgais i lofruddio, ymosodiad gyda’r bwriad o achosi niwed, ymosodiad gydag anafiadau, bygythiad o ladd, troseddau rhywiol (gan gynnwys treisio a lladrad); Lle bo cyllell neu offeryn miniog wedi cael ei ddefnyddio i anafu, ei ddefnyddio fel bygythiad, neu lle bo’r dioddefwr yn argyhoeddedig fod cyllell yn bresennol yn ystod y drosedd. Since 2008, knife crime has been defined as any offence that satisfies both of the following criteria: Is classified as an offence of homicide, attempted murder assault with intent to cause harm, assault with injury, threats to kill, sexual offences (including rape and robbery; Where a knife or sharp instrument has been used to injure, use as a threat, or the victim was convinced a knife was present during the offence.

Mae troseddau meddiant cyllyll wedi cael eu diffinio fel: Bod ag eitem â llafn neu bwynt miniog mewn man cyhoeddus (gan gynnwys yr ysgol); Bygwth â llafn neu eitem â phwynt miniog mewn man cyhoeddus (gan gynnwys yr ysgol); Bod ag arf bygythiol yn eich meddiant; Defnyddio unigolyn i edrych ar ôl arf bygythiol; Bygwth ag arf bygythiol. Knife possession offences have been defined as: Having an article with blade or point in a public place (including school); Threatening with a blade or sharply pointed article in a public place (including school); Possession of offensive weapon; Using someone to look after an offensive weapon Threatening with an offensive weapon.

3. BETH YDYW? WHAT IS IT? 3 Gorffennaf 2015: Cafwyd cyhoeddiad gan y Weinyddiaeth Gyfiawnder yn hysbysu y byddai’r ddedfryd ‘dwy drawiad’ am feddiant cyllyll yn dod i rym ar 17 Gorffennaf 2015. Darparwyd y gallu i osod y ddedfryd hon yn sgil diwygiad i Ddeddf Cyfiawnder Troseddol a Llysoedd 2015. 3 July 2015: an announcement from the Ministry of Justice – informed that the ‘two-strikes sentence for knife possession would come into force on 17 July The provision for this sentence came about due to an amendment to the Criminal Justice and Courts Act 2015.

Yr hyn ydyw What it is Mae’r ddedfryd ‘dwy drawiad’ newydd yn golygu fod oedolion a euogfernir fwy nac unwaith o fod â llafn yn eu meddiant yn wynebu dedfryd carchar o leiafswm o 6 mis ac uchafswm o 4 mlynedd. Bydd troseddwyr ifanc 16 ac 17 oed yn wynebu gorchymyn cadw a hyfforddi o leiafswm o 4 mis. The new ‘two-strikes’ sentence means that adults convicted more than once of being in possession of a blade face a minimum 6 month prison sentence and a maximum of 4 years. Young offenders, aged 16 and 17, will face a minimum 4 month detention and training order.

5. Yr hyn ydyw What it is Mae troseddau MEDDIANT arfau hefyd wedi cynyddu yn ystod y cyfnod diweddaraf (2016/17) ar draws Cymru a Lloegr. Dros y 3 blynedd diwethaf – rhwng 01/08/2014 a 31/07/2017 – cafodd cyfanswm o 280 o droseddwyr a rhai dan amheuaeth dan 18 oed eu canfod am 234 o droseddau ar wahân â chyllyll ar draws Gogledd Cymru. POSSESSION of weapon offences have also increased in the most recent period 2016/17across England and Wales. Over the past 3 years, between 01/08/2014 and 31/07/2017, a total of 280 suspects or offenders aged under 18 have been identified for 234 separate knife crimes across North Wales

Canlyniad trosedd newydd gan berson ifanc 16 oed neu hŷn lle bygythir unigolyn yn gyhoeddus neu ar dir ysgol fydd cyhuddiad ar unwaith, gan fod y drosedd hon yn arwain at ddedfryd o leiafswm o bedwar mis o orchymyn cadw a hyfforddi ac o’r herwydd ni ddylid delio â throseddau o’r fath trwy ddull gwarediad y tu allan i’r llys. Mae 3 math o Warediad y tu allan i’r Llys: Datrysiad Cymunedol; Rhybudd Ieuenctid a Rhybudd Amodol Ieuenctid. A new offence of threatening a person in public or on school premises will result in a youth aged 16 or over going straight to charge, as this offence carries a minimum sentence of a four months Detention and Training Order and therefore should not be dealt with using an out of court disposal. There are 3 types Out of Court Disposal’s (OOCD): Community Resolution; Youth Caution and Youth Conditional Caution.

There is explicit reference within the legislation to the court’s duty to take into account the welfare of the child when sentencing 16 and 17 year-olds. However, it is essential across North Wales that we all work to educate young people of this consequence of knife crime in order to prevent 16 and 17 year olds from entering custody
