Background On April 20, 2015, the City was notified by the news media that a small amount of radioactive material was accidentally released inside Thermo Fisher Scientific's facility The City immediately took proactive, deliberate measures to obtain answers from Thermo Fisher Scientific and the Department of State Health Services, the environmental regulatory agency responsible for monitoring radioactive materials/cleanup The State assured the City that the contamination poses no health risk The City continued dialogue with the State regarding the decontamination of the site

Background – 2016 In March 2016, the State notified the City that contamination was also detected in a City-owned ditch located adjacent to the Thermo Fisher Scientific facility. The State assured the City that the contamination poses no health risk.

Steps taken by the City:
Hiring of an independent environmental consultant, ESE Partners to conduct in depth testing of our ditch ESE confirmed that the contamination poses no health risk

Steps cont. April 1 – City issued NOV to Thermo
Issuance of Notice of Violation of Storm Water Quality Management and Discharge Control Ordinance Negotiation of a remediation agreement with Thermo Fisher Scientific to ensure clean up of affected properties April 1 – City issued NOV to Thermo To ensure that the City-owned property will be remediated to its original condition as required under Chapter 11 of the Development Code (Stormwater Discharge), the City proactively pursued a remediation agreement with Thermo Fisher.

Terms of Remediation Agreement
The Remediation Agreement requires Thermo Fisher Scientific to: Continue to survey and test all adjacent and affected properties Remediate all affected properties to their original condition Remain the legal owner of all contaminated properties and dispose of contaminated materials at a licensed facility

Terms cont. Reimburse the City for ALL costs incurred by City related to the negotiation and administration of the Settlement Agreement (outside legal counsel, independent environmental consultants, city staff time) There will be no costs to the taxpayers

Terms cont. Cover all related costs associated with cleanup activities until the State determines all affected properties have been remediated Indemnify and Release the City against all claims that may arise related to the discharge

Next Steps Finalize the Remedial Action Work Plan
Within two weeks, Thermo Fisher Scientific will begin remediation of the City’s ditch Thermo Fisher Scientific will continue to survey and remove contaminates as they are found on affected properties

Next Steps cont. State and ESE will verify remediation is complete on City property State will verify remediation is complete on all other affected properties The City will continue to work with the State and our elected representatives to improve communication of any future incidents
