2 Introduction CLP Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures : Applies to substances and mixtures placed on the market Introduces GHS criteria for C&L Obligation of the suppliers(manufacturers, importers and downstream users) to classify substances and mixtures before placing them on the market : If no harmonized classification, self classification. Dangerous substances of the Seveso directive based on this classification : Need for a homogeneous self-classification in order to avoid any discrepancies in the application of the Seveso directive. 3 Introduction In France, 2 main issues to be tackled :
How to solve the problems resulting from potential discrepancies in the self-classification of a same substance or mixture ? Verification of the accuracy of the classification, Verification of its impact on the Seveso scope. How to deal with their impact on the application of the Seveso directive ? 4 Verification of the accuracy of the self- classification
Tools to detect any discrepancies between different self-classification of a same substance Centralized software : S3IC Management and monitoring system of the classified installations for environmental protection ( classification of all hazardous industrial facilities, identification of the types of substances and quantities present onsite, etc). Sectoral working groups Exchange of experiences and good practices between inspectors, analysis and comparisons of establishements in a same field of activity (chlorine, chemicals, ammonia, etc). Ex. : Discrepancies between SDS regarding anhydrous ammonia could be identified in 2009. Ministère de l'Écologie, du Développement durable et de l’Énergie 4

5 Verification of the accuracy of the self- classification
Common inspection body for REACH / CLP / Seveso Common actions defined at a national level. Joint and coordinated visits, exchange of information when discrepancies identified. Network and focal point for the classification at the national level. For the Seveso establishments, transmission of all the safety reports and SDS at the disposal of the inspection. 6 Verification of the accuracy of the self- classification
Actions to be taken following the identification of a discrepancy Research on the classification carried out by the INERIS Analysis of all the SDS available. New tests and experiments if necessary. New classification proposed. Ministère de l'Écologie, du Développement durable et de l’Énergie 6

7 Verification of the accuracy of the self- classification
Based on the INERIS proposal, new classification by the Préfet (representative of the State at the local level) and where required, application of the Seveso directive. Exclusive competence of the Préfet who delivers the permits to operate (authorization procedure, mandatory for the Seveso establishments). 8 Potential issues following a reclassification
If an establishment becomes Seveso following a reclassification, which deadlines apply to comply with the Seveso obligations ? Deadlines of the Seveso directive : 1 year to elaborate the MAPP 2 years to elaborate the SR, the internal emergency plan and the SMS. 9 Potential issues following a reclassification
Starting point = date of reception of the letter announcing the change of classification by the distributor Problem if no information transmitted to the CA. But obligation of the operator to inform the CA of any change happening on the site. Administrative and judiciary penalty if non-compliance.
