STATE POWER!! Define: Powers not given to the Federal GOVT are Reserved for the States State militia – National Guard (2nd Amendment ) Elections – (Art. 1, Sec 4) - State resp. to run elections, not Federal GOVT Reserved Powers of the States…aka… State Powers

4 2. Concurrent Powers Powers given to both the State and National GOVT
EX: Establishing Highways, pass and enforce laws If power not given (delegated) to National GOVT, it is assumed to be a concurrent power

5 3. Supremacy Clause (Art. VI, Sec. 2)
U.S. Constitution, Federal Laws, and Treaties are the “Supreme Law of the Land” State and local laws that conflict w/Constitution, or Federal Laws are invalid EX: Marijuana, Vermont money, Segregation HUGE!! Basically, if a federal and state law contradict, then when you're in the state you can follow the state law, but the feds can decide to stop you. When there is a conflict between a state law and federal law, it is the federal law that prevails. USA!!!
