2. Status of Community Engagement Requirements in the States
In January 2018, CMS issued guidance on Section 1115 waivers for community engagement and work requirements.
CMS has approved 4 waivers, and an additional 11 are pending. KY’s waiver is undergoing additional review at CMS following legal action.
Waivers condition continued eligibility on reporting of approved activities, such as employment, job search, volunteer services, or job training programs. Several exemptions apply in each waiver, as well as good cause/cure opportunities to support continued eligibility among those who are subject to the requirement.
