ToughStuff International Limited (TSI) is a social enterprise which aims to provide affordable solar-powered products for low income people, primarily in the developing world, replacing expensive and environmentally damaging alternatives such as kerosene lamps and batteries. It aims to reduce poverty and CO2 emissions, remove the environmental damage of discarded batteries, enhance health, increase micro-enterprise employment and through this, help to bring about the achievement of the Millennium Development Goals. ToughStuff already operates in Madagascar and has partnered with a microfinance institution to support entrepreneurs there, and has received approval from the government of Madagascar for its work. ToughStuff intends to make its products widely available through companies, national distributors, NGOs and public sector bodies throughout sub-Saharan Africa and in Asia. ToughStuff also plans to provide other socially valuable products such as household level water filters or mosquito nets, once the brand has built a reputation for quality and durability, designed for the needs of the most poor. Although lawyers in China were found to advise in relation to Intellectual Property protection there, assistance was also sought in relation to many other jurisdictions in which we couldn’t find lawyers to help. Perhaps HSBC lawyers could have provided this valuable assistance. 12

17 Many developing economies contain abundant natural resources, such as timber, diamonds and oil. Yet rather than benefiting a country’s citizens, natural resources can incentivise corruption, exacerbate conflict and impact on human rights and the environment. Natural resources

18 Many high profile development issues are taking place in areas with an abundance of natural resources or desirable land, which have become the focus on corporate activity. The interaction between local communities, indigenous people, the state and corporations in some of these areas has raised serious development concerns, often fuelled or led to conflict, and caused environmental degradation. As foreign investment and market liberalisation change the nature of rural land rights in many developing countries, development organisations have become ever more involved in issues of ownership and access to land.  Role of private sector
