Opening Constitutional Safeguards

2 Locker Search A high school principal has reason to suspect some students of bringing weapons onto campus. After receiving a tip from a teacher, the principal searches the lockers of three students and finds a knife and a small handgun in one student’s locker. The other two lockers turn up nothing.

3 Locker Search In this situation, what rights do the students assigned to these lockers have?  What powers does the principal, acting on behalf of the student body, have?  On a high school campus, should authorities be allowed to search student lockers whenever they want?

4 Constitutional Safeguards and Limitations of Rights

5 The Constitution of The United States safeguards are not in place to limit individual rights, but to protect those rights.

6 What are Constitutional Safeguards?
The rights of many do not out weigh the rights of few! In the locker search example, the rights of the students against search and seizure without a warrant is taken. Did the school have probable cause?

7 1st Amendment Limitations

8 Religion- The Person Can Cannot
Choose whatever religion Lead a prayer in most examples Ask questions about religions Worship who ever you want Break the law and claim it is religious belief Raise children without education Deprave children of basic needs

9 Free speech- The individual can:
Say any political belief Protest (without getting out of control) Say things about someone that are true Burn the flag Say racist and hate slogans Free speech means someone might say something you disagree with

10 Free speech—limits on the person
Threaten to blow up airplanes, schools or the president Sexual harassment Create too much social chaos Extremely crude language in a public form Disrespectful, vulgar language in schools Hate crimes

11 Freedom of the Press The Press: Can Cannot
Print any political position Make fun of people, especially politicians Expose wrongs by the government Say things you might not agree with Libel– intentionally injuring a person’s reputation by false facts Disclose defense-security secrets Detail how to make a certain weapons

12 Freedom of Assembly- The Individual Can Cannot
Protest Parade (with a permit) Parade chanting hate slogans Gang members can congregate in public Protest by throwing rocks and breaking windows Hang out on private land against owners will—loitering Teen curfew

13 What are Students Rights?
Within the educational setting, the right to free speech is implemented in ways that DO NOT interfere with schools’ educational mission.  Students do not have full rights until they are 18.  For example if kids do not come to school who can go to jail- the parents!

14 Scenarios Read each scenario and decide if the persons constitutional rights are being denied. Answer the questions that go with them. Hint: In at least one scenario the persons constitutional rights are not being denied.
