2 Essential Question Did the Florida Supreme Court violate Article II, Section I, Clause II of the U.S. Constitution by making new election law? Does the non- standard recount of the votes violate Equal Protection and Due Process?

3 Background Information
Florida Supreme Court ordered that a court in Leon County tabulate 9000 ballots by hand. It also made every county recount all votes that did not show a vote for president. Bush asked Supreme Court for review, and the court reviewed it on December 11, 2000.

4 Constitutional Principles Related to Case
Article 2,Section 1, Clause 2 = Each state gets a certain number of electoral votes based on the number of Congress members. 14th Amendment = No one’s ballot can be devalued because of the Equal Protection Clause.

5 How Did Supreme Court Answer the Question? Why?
In 7-2 vote, the court stated that the manual recount was fine, but in another 5-4 vote, they decided that the counties couldn’t recount the votes because there was not enough time. This is because of the Equal Protection Clause stated in the 14th Amendment.

6 The Impact of the Case to Society.
This case showed everyone that every vote needs to be counted, if not it would be declared unconstitutional.

7 Why is this Considered a Landmark?
This case helped solve one of the biggest and closest presidential elections ever.
