2 Workers injured in a construction accident may be entitled to compensation under Workers’ Compensation. Workers’ Compensation is a state-mandated program that consists of specific benefits to workers if they are injured while on the job. Under Workers’ Compensation, an injured worker may be entitled to the following:

3 Medical Treatment An injured victim has the right to all reasonable and necessary medical treatment to cure or relieve the effects of his or her injury. This may include medical bills, prescriptions and hospital visits.

4 Temporary Disability If the injury causes the victim to take time away from work, he or she may be entitled to temporary disability payments. This includes two-thirds of his or her average weekly gross pay every two weeks.

5 Permanent Disability If the injury causes a permanent impairment, the victim may be entitled to a monetary award. The award amount will depend on how severely the injury has impacted the worker as well as the age, occupation and earnings of the worker at the time of the injury.

6 Vocational Rehabilitation
If the injury prevents the injured worker from returning to his or her former job, the employer must provide assistance in getting other employment. During vocational rehabilitation, a victim may be entitled to a partial income from the employer.
