2. The Facts - SB65
SB65 and administrative rules creates the Public Education Online program.
Allows students to enroll in online courses from any Provider LEA offering an online program.
Provides students high school graduation credit through the completion of online courses.
Redistributes MSP funds from Primary LEAs of enrollment to Provider LEAs of online courses.
The Student or Parent indicates the student will be enrolling in an online course or courses.

3. The Facts - SB65
The online course can be provided by the students Primary LEA of enrollment, or any other LEA in the State of Utah – the Provider LEA.
The student’s Primary LEA of enrollment amends the students SEOP to include an online course provision.
The student’s Primary LEA of enrollment fills out a Course Credit Acknowledgment (CCA) Form.
A district providing the online course does not need to fill out a CCA for their students.

6. The Diversion of Funds IF THEN
After the CCA is completed and submitted to the USOE, diversion of your funds at the course level begins . . . IF
the student logs into the online course at least five times in the first ten days . . .
THEN
the USOE will withhold (forever) $ of your funds and remit $ or 50% to the Provider LEA conducting the online course.

7. The Diversion of Funds IF THEN
the student completes the course within the specified time, a semester/year depending on the course requirements . . .
THEN
the USOE remits the other $ or 50% of your funds to the Provider LEA conducting the online course.

8. The Diversion of Funds IF THEN AND
the student does not complete the course within the specified time, a semester/year, the student can remain enrolled in the course until completion, or graduation and IF the student completes the course prior to graduation,
THEN
USOE remits an additional $ or 30% of your funds to the Provider LEA
AND
$ remaining or 20% of your funds is retained in the USF.

9. The Diversion of Funds IF THEN
a student withdraws from an online course prior to ten days, or the student fails to actively participate and log-in five times during the first ten days . . .
THEN
the fund amount of $ would be remitted to the student’s Primary LEA of enrollment (your district).

10. Requirements
Amend students’ SEOP plans to facilitate online courses when requested by students/parents.
Remit a CCA (electronically) for each course to the USOE for students who request an online course.
Include information about the Program and Provider LEAs in high school registration materials.
Publish information about the Public Education Online program on your district/school website.
NOT “give preference” to an online course or Provider LEA.

11. Requirements
LEAs may not restrict a student from enrolling in an online course under the program that fulfills a graduation requirement.
Students may not enroll in online courses that would cause them to exceed normal course credit hours unless their SEOP plans for early graduation.
For enrollment purposes, students are still considered enrolled in their Primary LEA irrespective of the number of online courses they enroll in outside the Primary LEA under the Public Education Online program.

12. Requirements
Track course credits and assessment results for their students that take online courses from other Provider LEAs.
Provide for Open-entry, open-exit; allow online students:
the flexibility to begin or end study at any time;
to move through course material at their pace; and
to demonstrate competency when knowledge and skills are mastered.

13. The $$ Facts
In fiscal 2012, students may enroll for as many as 2.0 course credits under the program:
2.0 Course Credits x $ = $1, which would be diverted from your district to the Provider LEA conducting the online course.
This increases through 2017:
In 2013, 3.0 course credits at $2, may be diverted from your district.
In 2014, 4.0 course credits at $2, may be diverted from your district.
In 2015, 5.0 course credits at $3, may be diverted from your district.
In 2016, 6.0 course credits at $4, may be diverted from your district.

14. The $$ Facts
If you provide online courses, you could retain your funding by providing those online courses to your students.
If you provide online courses, the you could realize increased funding by enrolling students from other districts in your online courses.
If you do not provide online courses, you could lose funding when your students enroll in online classes offered by other districts or LEAs.
You may realize volatile class sizes as students in a single course divert to online courses.

15. Possible Solutions
Do nothing. Potentially lose money. Potentially lose student enrollment.
Use current homegrown online courses and project that a few students will take online courses and only in a select few subjects.
Use current homegrown online courses and partner with a third party provider to fill the curricula gaps.
Become a Provider LEA and partner with 3rd party provider.

What is it?
Created in May 2011 to begin the work of meeting the requirements and expectations of SB65.
Provides leadership, management and technical expertise in delivering online education to participating schools districts.
Who can participate?
All public schools who can benefit from providing online curriculum to their students.
Why participate?
To prevent your WPU from migrating to other districts or Provider LEAs.

18. Advantages of Working Together
Volume discount: We can drive the costs of the curriculum from vendors down. (Pushback—3rd party providers/vendors not wanted! We understand. We need to use them to fill the curriculum gaps that we may have until we can create our own).
Avoiding costly duplication: By working together we neither need to “start from scratch” nor create district-by-district the SAME product.
The coordination of online teachers (when needed) to keep the costs of delivering online education at a reasonable level.
Maintain the competitive edge. Offer the best curriculum experience at each of our high schools that Provider LEAs cannot.

We can meet the need of our students and parents who request online education. Whatever the course. If it is offered from any Provider LEA, we will offer it as well.
Collaborate on future proprietary curriculum development and upgrade Electronic High School Curriculum to excel those available from Providers LEAs.

Work to provide the vision and direction necessary to influence future policy decisions, along with a proactive response model.

Online enrollment is growing by 46% each year, and by 2019, half of all high school courses will be delivered online according to the International Association for K-12 Online Learning (iNaCOL).
