Continued Confusion about Process
Parents Don’t Realize Process is Simple: Parent or teacher/school staff initiates: Written request for mental health assessment and/or a functional behavioral analysis

ACCESSING ASSESSMENT If parent does not get an assessment plan in 15 days after district receives written request , File compliance complaint

PROBLEMS WITH Evaluation
Inconsistent policies and practices across state Often not done by staff with no clinical mh background or limited behavior background Often ignore critical information

LRE VIOLATIONS Children are often not offered meaningful MH or behav services outside of segregated setting

Limited “menu” of services/supports
MH services often limited to: Placement in “Counseling Enriched Setting” OR Counseling that is not coordinated with other services/supports

Increase in Restraint Seclusion
Restraint and seclusion happen most frequently in segregated settings Substantial risk of physical and emotional harm to child Adverse educational impact

CHANGES NEEDED More training to parents on how to access educationally related MH and behavioral services Improved statewide standards/technical assistance for ERMHS and ERPBIS assessments Data keeping and data analysis re: mh and behavioral services and assessments

CHANGES NEEDED Better state and district monitoring re LRE
Increase legal protections against non-emergency restraint and seclusion and dangerous types of restraint and seclusion Better enforcement of monitoring of current state laws related to restraint and seclusion
