1.8 – Process of making law in parliament
Key Concept When the government has decided to change a law or introduce a new one, it must follow a certain process. The process is designed to give parliamentarians time to consider a prospective piece of legislation (a Bill) and to review it carefully and suggest amendments if necessary.

(A Bill is a proposal for a new law) Types of Bills
Government Bills Proposed by the government ministers. These Bills are guaranteed passage through the lower house due to the government having a clear majority. Private Members Bills Generally do not have the support of the government and are usually introduced by Opposition members or government backbenchers. These Bills often fail because they do not reflect the policies of the government and will be voted down in the lower house. Money or Appropriation Bills Relate to government spending or raising taxes. These Bills cannot originate in the Senate. The Senate may not amend Bills that impose taxation and other kinds of appropriation Bills that will increase ‘proposed change or burden on the people’, The Senate can ask the House of Representatives to make amendments to these types of Bills.

Before the Bill comes to parliament
The parliamentarian responsible for the bill MUST complete the following Have the bill drafted by the Office of Parliamentary Counsel. (Experts in drafting legislation) ensure legislative, procedural and appropriate language is used. Conduct briefings with the PC to ensure correct details and intent of the legislation is fully outlined Review draft Bill and recommend changes as required Ensure final printing of Bill and table same in parliament
