2 Background Council deferral of application for HH outside of policy area – 14 June 2017 Deferral was to allow consideration of a revised policy which would potentially include Lot 48 in Policy Area

Direction provided by Council at that time: Concerned with increase of holiday houses in terms of impact on affordable housing and residential amenity Concerned with impact on traditional tourism providers

4 Regulatory Requirements
Holiday Homes subject to same requirements as other forms of accommodation: Planning – Require Development Approval. Health Act 1911 WA Building Regulations Fire – SPP3.7 and Guidelines Rates – same category as chalets etc.

5 ADVERTISED POLICY CHANGES
FORMAT Change name of Policy to LPP7 – Short Stay Uses in Residential areas. Remove ‘performance criteria’ from the Policy

LOCATION Modify Policy Area Map

LOCATION Include a policy provision which limits guesthouses to the same areas as holiday houses. Modify Policy provision AD1.3 which currently allows Holiday Houses on lots greater than 1,000m2 such that it prevents holiday houses other than in defined areas unless the property is 1ha in size.

8 ADVERTISED POLICY CHANGES
MANAGEMENT Modify Policy provision AD5.2 so that a manager must be located with 35mins drive from the holiday house (reduced from 1 hour) Include a policy provision which allows the owner of a holiday house to reside in an ancillary dwelling located on the same property.

9 ADVERTISED POLICY CHANGES
SIZE Remove specific reference to a maximum of 8 occupants. Include provision, which confirms that each bedroom can only be accommodated by a maximum 2 persons over the age of 2.

10 ADVERTISED POLICY CHANGES
FORM Include provision which more clearly articulates the form of a guesthouse as needing to be purpose built (as distinct from a dwelling) Include a provision, which more clearly articulates the form of bed and breakfasts as being conducted within a dwelling.

11 ADVERTISED POLICY CHANGES
AFFORDABILITY Include a provision which prevents the use of single bedroom dwellings for holiday house use. Include a provision which prevents the use of an ancillary dwelling for holiday house use.

12 ADVERTISED POLICY CHANGES
FIRE Include a policy provision to reiterate the requirements of SPP3.7 and the Planning for Bushfire Prone Area guidelines which do not support ‘vulnerable landuses’ within areas having a BAL rating of 40 or FZ.
