Punishment Justifications
Retribution- Punishment is necessary, created imbalance in social order Deterrence- Criminals and others see consequences of punishment, therefore they will follow the law Rehabilitation- Not bodily punishment, instead a mind makeover (reeducated)

Types of Punishment Incarceration- Jail/prison time. Jail is for short periods of time, those awaiting trial, and persons convicted of misdemeanors. Prison is for sentencing one year or more and those convicted of felonies.

Types of Punishment Three Strikes Laws
Enacted by state governments in 1990s stating that repetitive felons deserve long term incarceration if convicted of three or more felonies!

Types of Punishment Mental Hospital- Sentencing for the mentally ill. Unfortunately, many are under diagnosed which over crowds the prisons/jails.

Types of Punishment Monetary Compensation- A payment of money or the return of property. Plaintiff will receive restitution-restoring something that was taken away Confiscation of property- If the criminal is unable to pay the money, the courts can take away their property. For lesser crimes, criminals will perform community service.

Types of Punishment Parole: Supervised release of a prisoner before his/her sentence is finished. Returned to jail/prison for violating parole. Probation: Suspends a prison of jail sentence for fixed period. Offender can return to the community. Assigned to a probation officer.

House Arrest Confinement to one’s home. Leaving the home is restricted. Suspension in when a privilege is taken away for a specified period of time. Example: Removal of driving privileges

Types of Punishment Detention: Allows the state to hold people, either to punish or investigate them. Juvenile Detention holds minors/children Detention Cell
