5 HF Waste Streams (4) Fluids (water and additives) from the fracturing mixture: fluids sent downhole; Formation water: fluids naturally occurring underground in the geologic formation, frequently salty (also called brine), can be treated and used as a de-icer or dust-suppressant; Solids—sand, dirt & mud, sludge, drill cuttings, rock, residuals, drilling equipment at the end of its lifecycle; Radioactive Material---Naturally-Occurring Radioactive Material (NORM); TENORM

6 CT HF Waste Moratorium CT Public Act (P.A.) 14-200, passed in 2014.
Established a Moratorium on fracking waste activity in CT. Moratorium Applies To: accepting, receiving, collecting, storing, treating, disposing and transferring such waste. Includes all portions of the waste stream: waste water, solids, brine, sludge, drill cuttings, and any other substance. Moratorium lasts if and until DEEP adopts rules categorizing fracking waste as federally-defined hazardous waste.

7 Cont’d Law provides OPTION not to adopt regulations, in which case the moratorium and all of its prohibitions stay in effect. DEEP has confirmed it will not adopt regs by 7/1/18 deadline, so moratorium remain in effect. There is no sunset clause.

8 Cont’d Legislature adjourned on May 9, it refused to pass a new law that would turn the moratorium into a permanent ban. DEEP regs were not issued by 7/1/18, so moratorium stays in effect! No HF wastes allowed in CT! No recycling or treating at CT water treatment plants allowed. HF Wastes: in CT whatever the question---the answer is NO!

9 Even if DEEP Regulations Not Adopted, Fracking Waste Cannot Come to Connecticut!
Can any portion of the Waste Stream come to CT: No, the moratorium passed in 2014 does not sunset and remains in effect even after July 1, 2018. Can the Waste Water be buried here? No: there are no Class II Underground Injection Wells anywhere in New England. Note: 90% of the waste water stream in PA is recycled! Can Radioactive Waste come here? No: there are no radioactive waste sites anywhere in New England.

10 Municipalities--Conclusion
Why would any Connecticut municipality spend time, money and effort adopting a local hydraulic fracturing waste ban when that waste HASN’T come to CT, ISN’T NOW coming to CT now, WON’T BE coming to CT in the future, and the CT legislative moratorium remains on the books???
