4 Preserve the Scene! Section 55 of HSWA requires that after a notifiable event: Site is not disturbed until authorised by an inspector (unless rescuing or making safe) Failure to do so: Personal fine up to $10k Company fine up to $50k

5 CAA HSU Response HSU not an emergency response unit
We respond to notifiable events (most) Identify duty holders – PCBU, Officers, Workers etc Identify relevant duties that were owed Look for systematic approach and effectiveness

6 CAA HSU Response Look at risk management – is risk managed to as low as reasonably practicable? Would a reasonable person have done more? Have the duties required by the HSW Act been met? What is the most appropriate action to rectify?

9 What is a notifiable incident?
Unplanned or uncontrolled AND In relation to a workplace AND Exposes any person to serious risk of injury or illness AND Came from an immediate or imminent exposure to a hazard
