CIL and the Regulation 123 List

What is the Community Infrastructure Levy (CIL)?
Levy on new development to generate funds to provide infrastructure to support growth How it is spent is set out in ECDC CIL Governance document Can only be spent on projects on the Regulation 123 List Parish Council gets 15% ‘meaningful proportion’ (25% if have Neighbourhood Plan) The purpose of CIL is to raise funds from developers who are undertaking new building projects, to help pay for infrastructure that is needed to support new development. CIL can be used to fund the provision, improvement, replacement, operation or maintenance of infrastructure If the extra 10% of CIL is the main reason for producing a Neighbourhood Plan please bear in mind: Neighbourhood Plans can take between and year and two years to complete They can cost from approx £10,000 upwards The extra 10% is not backdated so only applies to CIL generated after the Plan is adopted The Parish Council will still get 15% of CIL without one In low growth areas cost and effort involved will outweigh the additional CIL generated. Ave property (if not granted self build relief) generate £10k CIL PC would get £1,500 at 15% and £2,500 at 25% Not all development pays CIL - i.e. PP granted pre CIL, under 100sqm, affordable housing, charitable relief (e.g. CLTs) self build relief.

Regulation 123 List (R123 List)
List of projects identified by ECDC in consultation with stakeholders, as necessary infrastructure to support sustainable growth and achieve corporate priorities Split into major projects and strategic projects Any stakeholder can apply for project to be included on the list Being on the R123 List doesn’t guarantee project will receive CIL funding Major category is for infrastructure projects that have a value of £50,000-£2,000,000. 25% of CIL receipts will be made available for expenditure on projects that fall within the major projects category. Strategic category is for infrastructure projects that have a value greater than £2,000,001. 55% of CIL receipts will be made available for expenditure on projects that fall with the strategic projects category. What can CIL fund? CIL Regulations state that funds must be spent on ‘infrastructure necessary to support growth’ CIL can only be spent on capital projects, although associated revenue spending to maintain those capital items is also permissible It can be used to increase the capacity of existing infrastructure or to repair failing infrastructure, if necessary to support development CIL cannot be used to fund solutions to existing problems i.e. traffic management or on repairs to existing infrastructure in an area that hasn’t experienced housing growth The Planning Act 2008 provides a wide definition of infrastructure which can be funded by the levy, including (but not exclusively) transport, flood defences, schools, hospitals, other health care, social care, play areas, parks and green spaces, cultural and sports facilities, district heating schemes, police stations and other community safety facilities.

R123 List application process
Identify project, develop project plan, secure match funding and stakeholder support Submit Expression of Interest form Joint Steering Group will score application - if it meets criteria will make recommendation to Full Council Notification of Full Council decision Once project is established – apply to ECDC to release funds It was recognised by the Joint Member and Officer Steering Group that stakeholders needed greater clarity and information to enable more detailed bids to be submitted. Officers have agreed to hold a seminar in the near future which will set out the application process and the level of information that will be needed in order for a bid to be successful. Once the Expression of Interest has been received, Officers will convene the Joint East Cambs and CCC Member and Officer Steering Group for Planning and Transport group. The group will discuss and assess the application against the criteria. If the project meets the stated criteria and scores 50% or over, a recommendation will be made Full Council that it is included on the R123 List

Pre-application criteria
In order to be eligible for CIL funding a project must: Be necessary to support local growth Cost between £50,000 - £2,000,000 Be deliverable within 3-5 years Match funding and a financial contribution from applicant must have been secured If the project is highways or education related, the application must be accompanied by a letter of support from the relevant CCC department. Regulations state must be to mitigate growth – settlements with no growth will not be eligible for CIL funding. Total cost – Parish Councils should use their own funds for smaller projects. R123 List for larger infrastructure items. Match funding – making the money work so as many residents can benefit as possible. Letter of support – cannot fund projects the service provider does not support.

Evidence of need and stakeholder support Reference to ECDC corporate priorities, Local Plan, the Local Transport Plan Cambridgeshire Health & Wellbeing Strategy objectives and policies (if applicable) Details of project costs – including amount of CIL funding required Details of match funding – including some financial input from organisation making application Points also awarded for: Geographical coverage of project Level of housing growth

Successful Parish Council projects
Lode to Quy Cycle Path - Lode and supported by Swaffham Bulbeck PC Wicken-Soham-Ely Cycle Path – Soham T C and Wicken PC Both had: Evidence of match funding Good fit with ECDC corporate priorities, Local Plan and the Local Transport Plan Sustrans Feasibility report – looking at delivery Wide area of impact Consultation earlier this year invited stakeholders to submit bids for major projects (those projects with a value of £100,000-£4,000,000). The Council received 23 submissions in total. Scoring criteria was agreed by the Joint Member and Officer Steering Group. In order for a bid to be recommended to Full Council for approval, a score of 50% needed to be achieved. These bids were considered and scored by the Joint Members and Officer Steering Group. A summary of the bids that were submitted is provided at Appendix 3. The Joint Member and Officer Steering Group recommend the following projects to be included on the R123 list: Lode to Quy Cycle Path Expansion and relocation of Staploe Medical Centre – Staploe Medical Centre Witchford Household Recycling Centre - CCC Wicken-Soham-Ely Cycle Path

The Facilities Improvement Grant is for capital expenditure only. Ongoing project running costs are not eligible. Any parish which has an allocation of Section 106 (S106) funding or Community Infrastructure Levy (CIL) receipts that covers the full costs of the project are not eligible for Facilities Improvement Grant Funding. Please check on the webpage prior to submitting your application to make sure that there are sufficient funds available. Please note that there is a total of £45,000 available for allocation each year. The types of project that might be eligible will be dependent primarily upon evidence that an assessment has been made of local community needs.
