Gideon Vs. Wainwright By Luke Wilson and Lucas Weaver
3
What happened? Who were the two sides?
The two sides were obviously Wainwright and Gideon. Basically what happened was Gideon didn’t have a lawyer, so he asked to get appointed one, and the FL supreme courts didn’t appoint one to him, so he did a bad job of representing himself. After he was sentenced to prison he wrote a petition saying that it violated part of his 6th Amendment rights, right to lawyer no matter what, and right to speedy and fair trial.
4
The essential question
The essential question of this case is, “Does the Sixth Amendment’s rights to counsel in criminal cases extended to felony defendants in states courts?’
5
The Constitutional Principles?
The Constitutional Principles related to this case are the Sixth Amendment. The definition of the Sixth Amendment is right to a lawyer, and the right for fair and speedy trial.
6
The Outcome The outcome, or the decision of the case, was the FL Supreme Court denied Gideon, but the U.S Supreme Court decided that Gideon’s request, (everyone should have the right to a lawyer for free) was true and the U.S Supreme Court was in favor of Gideon.
7
Why is this a landmark case?
Impact on the U.S? Why is this a landmark case? The impact on the U.S was that now everyone has the right to a lawyer for free no matter what their background. This is considered a landmark case because of the same reason, it impacted the U.S, if that didn’t happen, then maybe we wouldn’t have a lawyer for free today, that is why this case is so important.
