Monitoring Visit Corrective Action Plan Development

“TEA failed to ensure that all children with disabilities residing in the State who are in need of special education and related services were identified, located, and evaluated, regardless of the severity of their disability, as required by IDEA section 612(a)(3) and its implementing regulation at 34 C.F.R. § TEA failed to ensure that [a free appropriate public education (FAPE)] was made available to all children with disabilities residing in the State in Texas’s mandated age ranges (ages 3 through 21), as required by IDEA section 612(a)(1) and its implementing regulation at 34 C.F.R. § TEA failed to fulfill its general supervisory and monitoring responsibilities as required by IDEA sections 612(a)(11) and 616(a)(1)(C), and their implementing regulations at 34 C.F.R. §§ and , along with 20 U.S.C. 1232d(b)(3)(A), to ensure that ISDs throughout the State properly implemented the IDEA child find and FAPE requirements.”

3 Corrective action plan timeline
Initial round of Public Comments ESC-20 Focus Group Meetings Revised Draft Plan Posted Final Plan Submitted February 20, 2018 February 26 & 27, 2018 March 5, 2018 April 18, 2018 TEA accepted initial public comments on the draft plan through an electronic survey. TEA conducted a series of focus group meetings targeting district leaders, families, teachers/service providers, and students. TEA will release its proposed corrective action plan as part of the SPED Strategic Plan. Additional public comments on this plan will be accepted through March 31, 2018. The final State corrective action plan, along with the SPED Strategic Plan, will be submitted to the U.S. Department of Education.

4 Corrective Action Overview
The TEA will develop and implement a new State system of general supervision/monitoring to ensure all LEAs locate, identify and evaluate all children suspected of having a disability. The TEA will develop a child find campaign/activities AND compensatory service provisions. The TEA will develop state guidance and resources specific to special education evaluation/services, RTI, Section 504 and Dyslexia. The TEA will implement the new monitoring system with a special education escalation team for intensive technical assistance, as necessary.
