Bio-organic residues (1) All bio-organic residues are waste
2) Exclusion of: Residues as part of natural cycle: straw, felling residues, animal/ fish guts, discarded fish + (3) Exclusion of: Manure re-used in within the same agricultural holding + (4) Exclusion of: Manure applied on any farm land 1

Bio-organic residues When is manure a waste?
Other relevant legislation: Animal by-products Regulation 1774/2002/EC MS can restrict the exchange of unprocessed manure Nitrate Directive 91/676/EC restricts the application of manure on farm land 1

Joined Cases law C-416/02 and C-121/03: Manure is not waste if lawfully re-used as fertiliser in agriculture without prior treatment The re-use is not limited to the same agricultural holding 1

How to deal with waste arising in small quantities? this is a general issue, not only relevant for NACE A and B If completely excluded from reporting Exclusion from waste statistics No comparability between countries 1

How to deal with waste arising in small quantities? this is a general issue, not only relevant for NACE A and B Recommendation: Waste arising in small quantities should be included in the category “mixed and undifferentiated materials” and in the totals Explain in the quality report for which categories an estimation was not possible 1
