2 What is Jurisprudence? The study of law extends beyond the mere examination of rules and their application to society. The consideration of values, concepts, social, political and economic factors underlying the law itself demands a deeper form of legal study Jurisprudence is described as the science or philosophy of law that deals with both applying legal doctrine and investigating the concepts, notions, and principles of legal thought. Jurisprudence may be thought as a legal matrix that comprises many interlocking concepts, theories, principles and institutions.

4 Jurisprudence It can motivate us to consider whether the law is arbitrary, coherent, just, a tool of the powerful or the servant of the common good. Our respect for the law comes from the sense and meaning we attach to the rules and principles it encompasses Fairness, justice There are two overarching traditional schools of thought- Natural Law and Positive Law (more on that later)

judges function independently of the government that appointed them Their decisions reflect their own legal interpretation of the law and not the government policy Parliamentary Supremacy: parliament, the elected and representative body of the Canadian people, has the supreme power of making Canadian laws This is a funny issue in Canada…let me explain
