The Judiciary Act of 1789 gave the Supreme Court, among other things, the power to issue writs of mandamus to federal government officials. In an important decision, the Supreme Court held that the Judiciary Act was unconstitutional because nowhere in the US Constitution was the Supreme Court given the power to order a federal official to do something. This holding established judicial review, or power to determine the constitutionality of US statutes.
