3 Essential Question Were the procedures used to commit Gault constitutionally legitimate under the Due Process clause of the 14th Amendment?

4 Background Information
Gerald Francis Gault, fifteen years old, was taken to custody for an offensive call. His parents were not informed about the situation. Gault was previously on probation.

5 Constitutional Principals
14th amendment=Must be notified of charges, rights. No self incrimination. Equal protection under the law, and citizenship of any born or naturalized citizen.

In an 8-1 decision for Gault. The procedures were not legitimate and did not respect the constitution.

The impact was that Juveniles were given the same Due process rights as Adults.
