2 1-Encounter any challenges in renew MoU, Registration or update documents

3 LNGO Challenges: Required lots of information and payment (all requirements fills, but also paid a package US300). Officer was too bureaucracy and required us to follow what they want rather than the law or what it should be. Document no practical format for easy to accept by the MoI. Difficult to communicate with specialists and, in particular, he says that our file is misplaced, it is not easy to finish. The submission has been pending long, the feedback is unclear and take so long with back and forth many times. Difficult to find the point person for register and it was token so long. If the accepted letter from MoI takes long time, it unable to use as attached for tax payment. Should have online service for the registration and updated information Overall, we can work, but it is still a bit slow We faced challenge with update about changing ED to tax department. We need to change VAT certificate with a new ED picture. Now we still not get the one update one. It took months to renew Project Agreement with MoSVY as too many required documents need to be done (MoI haven't experienced yet).

4 FNGO Challenges Political tension between USA & RGC affect the delay in signing of MoU More documents required than before, i.e. Bank Accounts, etc. (the renewal of MoU with MoFA was in 2016). The process take longer with the update requirement, hence some information need to be verified and added. We have some challenges on some consistency of information and words use between the previous MoU (due to internal organization change) which require clarification process before the MOU is finally approved. Line ministry does not give support letter if the agreement lasts beyond the validity of MOU with the ministry of foreign affairs so it needs to be made amendment to align the ending time for both documents and it take a lot of time. Tried registration with MoFA, but MoFA requirement support letter from line ministry which XXX working with. XXX not implementation organization therefore, we need to get support letter from MoI (because our partner working with MoI). I submitted everything to MoI until now i heard nothing from. Delay of process and change of requirements Reporting of the previous MoU - timeframe of report was not clear Take long time and spend a lot of money.

5 2- Challenges with Visa Process for Expat Staff

6 LNGO Challenges It is a bit difficult, and to get the work-permit is not so easy and too slow in the process. Difficult to get NGO visa and have to pay for their visa extension Require more docs and the price is also more expensive There are lots of supporting letter and MoU There is only intern staff, they complete the document by themself, and my organization just provide the reference letter.

7 FNGO Challenges A lot of issues in the past 8 months.
The ministry always changed procedures without notice Slow, and keep adding new requirements without advising beforehand It's just taking longer now as it now has to go to both MoFA and the Consular Services Requirement of more, unregulated documents and unspecified delay of response. Many and very serious issues. The process is very much ad-hoc at the moment. a lot of delay and bureaucratic hassle. MoFA is asking a lot of new things, such as a change in titles of jobs, a supporting letter from line ministries, etc. MoFA is also pushing for business visa instead of official visa; business visa requires work permit and a quota for expats. Working slow of ministry staffs and difficult to contact such phone called. Especially they didn’t talk polite.

9 LNGO Challenges It is really difficult with online system and its need to take time too. It is good to go online, but fee is costly, i.e. the fee of requesting Quota is $20 but the online fee is $30. Very expensive for foreigner consultants. It seems they careless with us when we ask them so many times to issue those to all our staff. Very strict about the expatriate staff with more inquiry where staff is from and so on. Complicated and no proper information, application process is not clear and hard Complicated and after work end can't process it easy. It was unclear the information and we wait to get the information from CCC for that issue

10 FNGO Challenges Need a lot of time to submit and follow up
Not clear instruction from the ministry of foreign affairs and ministry of labor. We have not applied for work permit for foreign staff, we are all receiving the B (iNGO) visa Not required work permit as it is registered with MOFAIC No work-permit is required for foreign employees hold visa B or C with our FNGO if we obtain employment card for foreign employees from MOFA They require to register as an enterprise and the registering process is quite complicated for NGO. lack of registration at MoLVT + issue of quota (% of expatriates in the team)

4-Please response yes if you wish to organization a meeting, and Have other suggestions Yes (15) and No (2) Yes we wish to have a meeting with relevant ministries Yes, XXX need to help to find out clear information about registration or updating the information and also work permit for local staff and retirement We don't know how should be requested because experience so far it waste of time to meet and talk with them in this issue because it seems that they already prepare for the trouble The registration to be local NGOs or foreign NGOs should require more support letter, then when we are registered, to MOU with line Ministries should be more simple and less required paper works. Yes, CCC needs to find out about the work permit book for the Cambodian staff, in my organization, no one has the work permit book. Please help us to solve these problem with MoSVY and MoFAIC

No (9), Yes (4), and N/A (2) Yes, should organize a meeting with those relevant ministries; especially, visa unit department at MoFA. Yes. There is a specific issue for organizations working with Cambodian or international volunteers because volunteerism is not clear in the labor law and visa guidance Yes, with MoFA about visa (FNGO should receive official visa instead of business visa) and with MoLVT about the quota (FNGO should be exempted). It will be helpful to have and clarify specific challenges and expectation, especially for NGOs having to deal with lot of such process. The learning could then be shared. There is no clear guidance on work-permit, work-book, and employee card for foreign employees for FNGO from MoLVT and MoFA. There has been new regulation regarding the labor law: Pension fund, two-time salary disbursement. We would like to follow how this will be practiced. At this point, there's no difficulties met, but for future reference, we would like to be well informed. For this reason, I would like to be included in the meeting if possible.
