Fair Use and Copyright What is “Copyright”
Defined: Copyright is a set of exclusive rights granted to the author or creator of an original work, including the right to copy, distribute and adapt the work. Types of work?: ALL WORKS, videos, music, written material, all print material, all images, etc. Exception: A Title, Name, or Ideas cannot be copyrighted This is how you see movies with the same name

How can you tell something has a “Copyright?”
Anything is copyright the minute it is written, performed or created. There is no actual need to record it, although it's normally done to prove authorship. When you research or find information of any kind, ALWAYS ASSUME it is copyrighted

How do you get permission to use something that is copyrighted?
You simply need to ASK! If an owner gives permission, ensure that it is written permission either through a letter or

Legal Penalties for copyright infringement
1. Infringer pays the actual dollar amount of damages and profits 2. The law provides a range from $200 to $150,000 for each work infringed. 3. Infringer pays for all attorneys fees and court costs 4. The Court can issue an injunction to stop the infringing acts 5. The Court can impound the illegal works 6. The infringer can go to jail

Fair Use There are times in which you CAN use copyrighted information without permission According to the Fair Use Policy: “it is permissible to use limited portions of a work including quotes, for purposes such as commentary, criticism, news reporting, teaching, nonprofit educational purposes, and scholarly reports.”

Fair Use There is no specific number of words, lines, or notes that may safely be taken without permission. **Acknowledging the source of the copyrighted material does not substitute for obtaining permission. ** In other words, you CANNOT simply cite the reference as you could in a research paper

Fair Use Fair Use Unwritten Rule: In most situations you can use copyrighted video, images, and music for no more than 30 seconds! In the same situation, you cannot re-use or loop the same 30 seconds in the same instance or project
