2 HNA Lesson 32 Article 150- Arson Arson; definitions Arson in the fifth degree Arson in the fourth degree Arson in the third degree Arson in the second degree Arson in the first degree.

3 150.01 Arson in the fifth degree
HNA Lesson 32 Arson in the fifth degree A person is guilty of this when he/she intentionally damages property of another without consent of the owner by intentionally starting a fire or causing an explosion. Class A misdemeanor

4 150.05 Arson in the fourth degree
HNA Lesson 32 Arson in the fourth degree A person is guilty of this when he/she recklessly damages a building or motor vehicle by intentionally starting a fire or causing an explosion. Class E felony

5 150.10 Arson in the third degree
HNA Lesson 32 Arson in the third degree A person is guilty of this when he/she intentionally damages a building or motor vehicle by starting a fire or causing an explosion. Class C felony

6 150.15 Arson in the second degree
HNA Lesson 32 Arson in the second degree A person is guilty of this when he/she intentionally damages a building or motor vehicle by starting a fire, and when; Another person who is not a participant in the crime is present in such building or motor vehicle at the time. Class B felony

7 HNA Lesson 32 Arson in the first degree. A person is guilty of this when he/she intentionally damages a building or motor vehicle by causing an explosion or a fire and when: An incendiary device is propelled, thrown or placed inside or near such building or motor vehicle; or By an explosive; or Causes serious physical injury to another person other than a participant, or Caused with the expectation or receipt of financial advantage or profit by the actor; and when another person who is not a participant in the crime is present in such building or motor vehicle at the time. Class A felony
